Hi all,
just wondering if anyone out there can provide suggestions for software used to create a legal will.

I used the Self Counsel stuff and it was pretty simple to use. Maybe try checking your provincial gov't website (justice dept??) for forms. Sask had some forms on their site.

While the Self-Consel publications are pretty good in my experience, but I'd be careful in using them for anything but the most simple will. (A lawyer won't charge you that much, hell in Victoria you can get one done for about $150.) The problem is that in most cases e.g. the Self-Counsel do it yourself divorce forms, the court registry will tell you if there is a problem when you try to file the documents (and you can then fix them and refile). But with a do it yourself will kit, well you're dead and there's no chance of fixing it then.

(And if there are tax implications with the estate, the chance of problems rise exponentially.)

am I to take this as confirmation that you won't be willing assets my way???.....damn.

My advice would be that whatever you do make sure that you register your will through a notary or lawyer.

If you don't, then whoever happens to have it can deny that it exists if that suits them. If it's registered officially then whoever is doing probate on your estate will find it and it can't be hidden.

I'm with jj on this one....a will is hardly something to entrust to a self help thing. A basic will costs less than $300 for the original draft last time I checked.

Fortunately for me, I have no assets...so my rate if $299.99.

I agree with that, it will be registered, but I'd like to have that ability to create my own will and my wife's and change if necessary....and save a few dollars in the meantime.

Executing a will...

I had a most interesting experience with my mothers Will when she passed away a few years back. As I was the executor, I went to my lawyer to find out what was required and he advised he could handle the entire thing for about $10,000.00 plus filing fees of about $1100.00 and it would be settled in about a year. I thought, wow, that's a bit stiff and why so long?

I took the will to a notary and he said he could settle it for about $5000.00 plus filing fees of $1100.00 and it would take about six months. I thought, better but still a bit steep.

On my way home, I bought one of those self help books on filing a Will and I read it three times. I went to our local court registry for the required document forms and filed the papers with the VERY pleasant ladies at the registry. They were incredible with all their help. Tip: have them look the documents over for corrections BEFORE you hand it to them otherwise you may have to re-file at additional costs.

Anyway, I had all the documents filed, it cost me $350.00 plus filing fees of $1100.00 and it was ALL settled in SIX WEEKS.

This Will did not have to be probated. The purpose of probating is to involve the courts and this usually happens if the deceased had property outside of his/her resident province. That gets alot more complicated.

If your prepared to study and learn something new, you can save a ton of dough, and the best part is the lawyers don't get at the assets. My lawyer wanted to probate the Will and there was NO NEED TO. Just another money grab.
