Road Rage: What would you do?

I almost got my noggin caved in by a lunatic today. There is a side street that has speed bumps that when i see someone going really slow over them i'll past 'em. The street is really wide so its safe to do so. Well junior didn't appreciate me passing him and sped up to get ahead of me. Which he did..and almost collided with my 'buru in the prossess. I wasn't racing anyone i just wanted to get going. When we came to the intersection his mouth was flapping like our national flag on a windy day. I said "just get going." "Come on lets go." Well as he sat there he got madder and madder. He eventually got out of his car with one of those collapsabe clubs. He swung at my arm which was leaning on the door sile of my car. He just skimmed my that but connected with my car. The 'buru recieved minor damage to some cosmetic rubber. When he realized what he had done he got back in his car and left. I wasn't about to get out of my car even though i could have dropped kicked that 100 pound bag of shit. With my recent surgery i wasn't prepared at screwing it up over this.

Now as he was driving away this is where my brain was working overtime. First i'm thinking get his plate number and make of car........which i did. Now do i stay behind him and call the police? (I could have charged him with assult.) Or go home and with the information call the police and press charges? Or just ignore the whole thing. So far i have chosen the latter.

Just curious what do you guys think i should do? I don't have any witnesses even though there where other cars present.

If i'm living in a perfect world i'll be meeting up with toothpick another day. --- Kev

Ummmmmmmm, with no witnesses... After going to the police... with the make of the car, licence plate... & making your report...

The Police go to him, state what you have charged him with, all he has to say is "I did not do it", or something along those lines...

You have to prove your case beyond a reasonable doubt... & Besides you passed him on a road w/speedbumps... Hence you sped up to do so... Speedbumps are there to SLOW you down...

Not sure if you would win, really?

I don't know. I would make a police report. The cops may swing by, maybe not, but at least you have it on record. Maybe psyco boy took down your plate as well, and is planning some revenge later. I've known guys like that. They feel humiliated, like you really screwed them over. Just stop by the station before you hit the 5.

U shoulda just floored the gas when he's about to come near you.
That way, by the time he gets back into his car and shift, you and your Subaru will be long gone. He'll be totally frustrated having a hard time catching up to u. That'll piss him off big time and u should feel much better!!!!!

But if he has a faster car than yours, then I guess your out of luck.
btw, what kind of shitty car does he drive?

Well one thing i neglected to mention i was completely boxed in. I couldn't go anywhere unless i was prepared to crash into another vehicle. Which i was not.

I agree with Carlotta that you shouldn't have make a pass on a street where they have speed bumps. It wouldn't be good for your suspension anyway. And I am sure that move, even tho was not your intention, would piss people off.

I think the best way to drive defensively is to avoid such confrontation in the first place aka not make a pass on speed bumps, you can always wait for a min or so right?

If you're prepared to follow through with charges, go to the police. Police in the lower mainland have been targeting road-rage assholes for the last while. Sure, maybe he gets a knock on the door and denies it to the officers. They know he's full of shit, he knows they know it, and just maybe the asswipe a) was smart enough to go throw away his ASP and b) thinks twice before freeking out on the next guy who's only fault is driving a subaru.

People need to stop watching court show's on tv. Judges don't become Judges because they're idiots, and most of them are pretty good judges (no pun intended) of character. On the one hand you've got Kev, who if it comes to it, gets up on the stand and says, your honor, I was driving home, I was in a hurry, my bad, I scooted around a guy going really slowly on the speed bumps and get swiped at with an ASP baton for my problems.....you know, a Judge is likely to see that Kev's got absolutely no reason to be taking a day off work to go to Court on a lark, gee, he's probably there because he's bent out of shape that he met a wingnut on the road. And, in our other corner, he see's a neanderthal who is lying through his teeth.

And you know, the Judge isn't going to give a rats ass that you were passing, that you didn't have your seatbelt on, that you were picking your nose behind the wheel.

I say to make a police report then go to small claims court to sue for damages. That Judge will decide his credibility and yours, motives, etc and decide in your favor(how could they not?). Judge Judy and Judge Millian are my fav late night shows, so make sure you have paid the damage already so you can claim the loss, just estimates won't do. Good luck kev, go git him!

I almost got killed one night by some punk cutting me off at high speed who almost ran me off the road. Then when I caught up with him at the next light, he started yelling at me about how I had allegedly cut him off earlier when I had passed him. I was furious and got out to pick a fight with him and I yelled louder and was MUCH madder than he, so he took off as soon as the light changed. I followed him for awhile then gave up since he didn't damage anything. But if he did, whoa, I would be wearing his teeth as a necklace.

file a report ... the moment he got out of his car and approached you it was assault ... there was a case a while ago where a guy got out of his car to yell at someone and was charged with assault ... this idiot that you, kev, ran into did assault you ... it is no longer just 'road rage' ... doesn't matter whose fault it was or what caused it, it was still an assault and they will follow up on it.

just remember, if you are pissed and stay in your car to yell, it is okay: if you get out of your car and approach the other car, then it is no longer okay ...

will dig around to find the article that mentions the charges etc.

I'm gonna go along with the majority here and say make a report. In a case where this tool did the same to several other motorists, maybe a young mother with small children in the car or someone's grandmother, it's just the right thing to do. Especially if they reported him. Your added testimony would be important and just might prevent serious injury or worse to someone else. Glad you weren't hurt.

Kev I would just get his plate and go home and call the police and file a reprt. If I was you I would get the cops as involved as I could to make sure this little cock-sukker learns the true definition of having a bad day. Don't let this little prick get away with that BS.

I know it may seem like the cops would just say well we'll look into it and then they just kinda make a 1/2 assed atempt and then it's forgotten about. But hey some prick do gooder asshole phoned the cops on me because I threw a chocolate milk container out my window once and about 2 days later I received a call from the Police about it. For a moment I could't even remember what it was about.

One day I was 3rd in line going up a fairly wide road and this guy in his rather old Trans Am was kinda holding things up, infront of me some little nerdy guy in his 4 banger. Same as Kev he thought he was going to slow and TRIED to pass, pulled to the inside and gave that little piece of 4cyl shit all it had. Mr. Trans Am noticed this and unloded on the back tires and the 4 banger didn't have a chance. Far as I'm concerned it was hang way back and let these two play.

IMO there is rules of the road, but not the police kind, hitracks kind. If a guy pulls up in the curb lane in a Viper, Vette, or AMG Benz, etc.... you automatically give it to him. Aything remotely similar to your car you make him work for it.

Kev once you saw the little cry baby gettin out you should have just busted outta there, but you didn't. Call the cops and make the little bastard squirm.

If you don't, this tool will be satisfied he got the better of you, and go on to do it to someone else. LG is right. Nip it in the bud, for his own good and the protection of others. If he sees his ASP brings him a lot of grief, he's more likely to put it away for good.

I'd say file the report because this guy could be dangerous - BUT - you were initially in the wrong for passing someone actually driving safely over speed bumps. (Ever consider they were installed because someone got hit by a driver speeding thru that neighbourhood?) It obviously was pointless to pass the guy anyway as you stated you were then boxed in. If you were driving properly and not so impatient the situation never would have happened. How many of us have been tempted to do what the other guy did after witnessing somone pull a similar, pointless illegal stunt?

If the damage to your vehicle was significant enough (amazing what it costs to fix small dents today in cars) and if you want to claim it from ICBC against your collision or comprehensive deductible then you you have to file a police report. Also, you can sue him in small claims to recover the cost, repay ICBC and thus restore your "no claims" status. In small claims, the judge decides on a balance of probabilities (not the criminal standard of beyond a reasonable doubt). It will then boil down to credibility - which you will have supported yourself by having the details you have recorded and by filing the police report.

If nothing else, you'll have the pleasure of knowing you pissed him off and made him waste a day in small claims court. Even if you lose, you're only out a few bucks and you can always thump him when you get outside the courthouse if no one's around to watch!

DON'T REPORT IT NOW THAT YOU HAVE DESCRIBED THE INCIDENT ON THE WEB ... where LE is suspected to occasionally glance ... how many other people are going to report road rage today? ... do you think LE in one department can access a report from another department ... then again, you are retired, aren't you Kev?

Hey, do you really think for aminute LE has time to look into these website? They barely have enough money in their budgets to look after normal street policing and every other whimsical task assigned by micro-managing politicians. The only time they would check this website is under criminal investigation. Other than that, some pooning cops might wander in here, but not to survey or monitor our hard-to-trace IDs. They have much more pressing tasks at hand. Anyone who thinks otherwise, hasn't taken his medication today.

It is natural for hobbyists to fear the repercussions of being caught partaking in socially unsavoury activities. But let's not get too carried away by our fears of the unknown!

Kind of hard to believe this came from someone who was advocating for busting the micros. I wonder about the medication part as well.

Well CT whats interesting in the past your opinions about incidents like these were different. For example Todd Bertuzzi attacks someone and you say lets fry his ass. Buy when someone assaults me whether i was in the right or wrong with my driving is irrelevent you say Kev its you fault. Thats a double standard don't you think? Of course i wouldn't expect anything less from you CT.:rolleyes:

For disscussion the lane where i did my passing was a side street. ie. (59th between Ontario & Manitoba.) There was no yellow line nor any signs that says i can't pass. The pumps were put in because the street is so wide and long without intersections that it was being used as a drag strip. I was in my right to maintain the correct speed and pass someone who slowed down to a snails pace because they feel those bumps would damage there suspension. Was i wrong in doing that? Maybe, although i don't think so. I drove with care and attention.

And....

No matter what anyone thinks about my driving skills, i didn't deserve some toothpick taking a swing at me with a metal club. Thats assault.

And....

This toothpick may have been upset with me for passing him at first, but he had two of his friends in the car and i think he was just showing off. So we can rule out that this had anything to do with my driving. What it has to do with is someone with road rage who allowed an incident to go to far, and this is how people die. --- Kev
