the assumption is consent not given, if a lady fears it is is because it happened without being asked if it is ok.

That's where my mind went also. Like why is it something to be scared of having done to a person otherwise. I don't want to make this a loaded subject as consent is also a subjective topic decided upon by each individuals own personal boundaries.
