I have a friend who’s going through a fairly simple divorce. They are pretty much don’t want to spend money on lawyer fees but I was told they still have to go to a judge which is an extra $4k after the lawyer fee.
I’m just wondering if anybody would clarify this for sure and knows or went through recently.

Right, well having done this a couple times, the first long ago was painless, the 2nd more than 10 years ago but not that far back, was as fucking painful as any possible thing could be.
So
Fuck yeah, go for the simple, everyone agrees, bypass all the shit and get it done and save xxxxxxx$s

Use the internet as a guide asking the general question "how do I get a simple divorce in BC without lawyer and without a court appearance"

There are documents and such one can download but really its worth it to buck up for at least a notary to make sure all the documents are done right.

If you and spouse are amicable in dividing assets etc., then you don't need any of that. Just a legal representative for each party to ensure there is nothing unlawful or coercive happening.

If parties can't agree, then even with lawyers, it's typically mediation first, then a judge and then court. Even a judge will typically send you back to mediation again. By the time it gets to court it will be a bloodbath and no one except the lawyers benefit.

Not sure where the $4k came from, but you can do an uncontested divorce for about $500.00 all in.

If the two parties are amicable and the division of assets is easy, you can do a separation agreement with a template off the internet. It just has to be witnessed by third parties. Separation agreements don't need to be registered in court, so there is no fee.

For the actual divorce, there is a website called untie the knot (.ca) that I used. It's about $350 for the court fees to apply for and procure a divorce (which can't happen until they've been separated for a year). It took about 6 weeks from contacting the site to them finalizing the divorce. Then they mail you the divorce certificate.

The Divorce part is cheap with or without a lawyer, DYI $500-$700, with lawyer $1,500- $2,000.
It is the separation agreement that cost more. If he/she does not understand the difference, he/she needs a lawyer.
If their is property, kids, pensions, CPP, involved, cheaper in the long run to pay a lawyer now. If they have a mortgage the bank will insist their is a proper separation agreement.

Well said. My friend is going to do further investigation on their divorce but they are on the same page with the partner.

From HER side. She went to a lawyer and asked for info.
OK then that's her legal fees, nothing to do with the court or court costs. If this becomes a contested dispute, then this could be something asked for by the "winning" party.
