The complication of course is that because of the laws surrounding prostitution, when you visit an escort you are paying for her time, not for sex. And you can't file a human rights complaint for being denied something that is illegal. I guess if you wanted you could sit and talk to her for the hour, but any sex would have to be at her discretion because you are not paying for that. S.

Prostitution is legal in Canada this means absolutely that you can and do pay for sexual services, not simply "time".

This isn't a grey area, or anything that is affected by the added laws meant to control prostitution, and provided it is an outcall, everything including her coming to visit you to exchange sex for money is legal.

Does anyone else ever get tired of people repeating the same misconceptions over and over and over again?


I believe the reason any sp can refuse any potential client is related to one of the laws surrounding prostitution, regarding coercian. No one, including the government, can force a sex worker to provide sexual services. Meaning she can indeed pick and choose without any worries about a law suit.

ALEXIS, since you say you are pre-law - - you need to sharpen your thinking. The Canadian Charter of Rights and Freedoms is not limited "to things like employment, tenancy, etc. Not sexual services."

We, on this board, have numerous threads on how the Charter impacts the right of a Sex Worker to safety while working. We, on this board, have numerous threads on the right to consent.

Sloppy, quite frankly, lazy thinking has no place in the practice of law.
I was going to comment on that, but to say it isn't an "unwritten rule". I believe this is an actual legal issue, that if the lady says no at any time, proceeding further is assault. That doesn't make it an "unwritten" anything, imo, but something that is laid out in writing and legalese somewhere.

Gees, where i work where entitled to refuse a job if we don't think it's safe. If i was an sp & i didn't wanna see some older dude i'd just refuse the job cus i didn't think it was safe & say i think this older gentleman is going to stroke out if i suck his wang while doing a prostate massage!

"No means no" is an unwritten rule that if a woman says NO at any time before or during a sexual act, it means you have to stop doing what you're doing and if you continue against her will or consent you are guilty of a sexual offense. Law enforcement and the courts recognize this.

The discrimination laws are in place for things like employment, tenancy, etc. Not sexual services. The law does not have any place in it for a man to challenge a womans right to say no to a man regarding sex.
I agree common sense dictates that no means no, but I just found it a curious choice of words to say it is a rule we should all know about and that the courts enforce. It came across like me saying, don't you know about the "two plus two equals four rule" or the "I digest food rule." The difference is something that is a factual statement vs. a standard that is legislated into existence.

The courts do enforce some unwritten rules based on recognized standards of conduct, like the "Good Samaritan Rule" (http://en.wikipedia.org/wiki/Good_Samaritan_law) and the "reasonable man rule" (http://en.wikipedia.org/wiki/Reasonable_person) but my point is I found no such reference for the "no means no" rule. I stand corrected if you can find another name for the "no means no" rule.

I don't want to come across as nitpicking, but I believe you posted previously that your goal is to be a lawyer. A future lawyer making a legal argument in a legal discussion should back up their arguments IMHO.

This looks like a question for alaninburnaby. Could one, if he had the balls, pursue a case of illegal age discrimination?

There must be others in this age category who are curious about this point.
