The prosecutor should of took him to court, but with what results. It would be hard to find a jury that was not prejudiced against him because of the news coverage. It just would lead to re-trails and appeals, which would not serve the public interest in time and money for a false police report...
As for a supposed hate crime, I don't think any prosecutor would want to touch that in court (or a 50 foot pole), cause it could go ballistic through either the law end, or the public exposure could be disastrous for American racial relations.
Well, it would be hard to name an actual person who he slandered. "Some white guys" ? That's like when the mafia used to hijack trucks, but "convince" the drivers to tell the police it was "some black guys" who did it. (Or is that just an urban legend?)
I'll tell you what's not an urban legend: back in the 1990's, some nutcase mom drove herself and her kids into some pond in Massachusetts. Her kids drowned, but she didn't elect to join them in death, so when the cops interviewed her, she lied and told them that she'd been carjecked by "some black guy". Well, there was violence against blacks as a result, much of which was at the hands of the Boston police who started aggressively rousting every "some black guy" they could find on the streets. Of course, the real investigation later revealed that she had killed her own kids, but in the meantime, a lot of "some black guy"s had the shit beaten out of them for the supposed actions of one of their kind.
And so yeah, I agree, what Smolett did is dangerous - aside from the "crying wolf" reaction that will happen next time some gay & black (and non-famous) person actually does get beaten up by thugs.

Kamala Harris is Foxx's mentor. Jussie Smollett is a friend of Kamala Harris. the Obamas are friends with the Smolletts family. Michelle's former top aide contacts Kim Foxx re the Smollett case. OMG charges are dropped, police not in the loop, evidence sealed..voila no record. Not hard to connect the dots.
I think Smolett just got the "celebrity" discount from a clueless state prosecutor.
Whatever friendliness they may have had before, nobody as high up as Harris or the Obama would ever hesitate to turn their back on him. Rahm Emmanuel (the Chicago mayor) is even closer to Harris and Obama, and he is Smolett's biggest enemy right now. Believe me, the only place Smolett is going with any of these political people is under the bus.

First, people are accused of crimes all the time, by victims and the state. It's not wrong, or slanderous to accuse anyone of a crime, if youre prepared to back it up in court. Anyone wrongly accused should rightfully DEMAND their day in court, not have a secret deal erase the charges.
Not able to find a jury not prejudiced against him? Seriously? Well-publicized cases (much more publicized than this) are taken to jury trials every day.

Well, Smolett is himself responsible for any hype that might prejudice a case against him, so it would be absurd to let that be a reason to let him off the hook. Still, stranger things have happened.
