MELBOURNE - A man who had sex with a prostitute has refused to pay child support payments after she had his baby.

The married Melbourne man, who can be referred to only by the pseudonym Mr Lilley, claims the birth was a breach of the Trade Practices Act.

According to the Herald Sun, the man told Magistrate Grant Riethmuller he shouldn’t have to pay for the inadvertent offspring given the circumstances of the conception.

He said that he’d had “a consumer transaction” with the child’s mother, reports News.com.au.

The accidental dad said it was implied in the “contract” that the woman should have been taking measures for birth control.

The prostitute - known only by the pseudonym Ms Logan - did not appear in court, and details of her employer were not publicly revealed.

The magistrate heard the man had been paying casual child support payments of 100 dollars each week before he lost his 140,000-dollar-a-year job.

He allegedly cut the payments when he took another job with a significantly reduced salary and ran into money troubles.

Riethmuller also heard the man had a child with his ill wife.

However, the magistrate this week ruled the circumstances of conception had no bearing over the case and ordered the man to continue the 100-dollars a-week payments.

Sex without a condom is illegal in licensed Victorian brothels and escort agencies.

Of course you'd pay child support. Why is this even a surprise or an issue? Whenever you have sex with someone you are accepting the risk of a pregnancy. Everyone's reproductive rights end somewhere. A man's end when the penis goes in the vagina, a woman's end when she can no longer feasibly obtain an abortion. It's not fair, but it has to be to preserve bodily integrity.

If the condom breaks, she decides she wants the child you could be paying for years, including paying for university, sports, etc. Same as if you were married.

If this happens, pay the sp to go somewhere where abortion is legal and get they surgery done, it's much cheaper than pay child support.

Actually in BC at least child support goes to at least 19 but can go longer if the child is still dependent. There is no automatic cut off at 25 either.

lol, it's only until the child is 18 - unless the child goes onto post secondary education, in which case he would be responsible until age 25. That's Canada specific of course. Child support law in the USA is complicated because while there is a federal law that says that states have to have law on child support, the states aren't required to have the same level of support as other states. In the USA, it becomes very important which state you had the child in.

I've always had the policy of ignoring any statement about being on birth control or having had her tubes tied. If a guy doesn't wish to be a daddy, doesn't want to risk disease, he should have fun covered.

so here in Vancouver, you see your regular sp. Maybe you see her 2x a month for the past 6 months, so you've seen her 12 times.

The next time you go see her she says I'm pregnant, and you are the father.

Why would you imagine that just because someone is an escort that she would choose to have an abortion, or even consider it? Escorts can be anti-abortion, pro-choice, undecided, etc - just like everyone else.

Because the father is just a pooner. If the escort had the pregnancy with a SO, then it would be a different matter.

If that woman is anti-abortion, then it wouldn't matter to her who the father is, or what the circumstances were.

I don't know this woman or what her thought process was. I'm simply saying that you can't expect all escorts to be pro-choice. We are not a homogeneous group. There are different beliefs, values, and opinions about any number of topics, including abortion.

It is possible for someone to be pro-choice but to choose that it is not the option for themselves.

So, if a woman buys sperm from a sperm bank, somehow there is a release of the obligation of the biological father towards the child.

But not so if the man buys sex.

And yes, if the child is special needs, there is no expiry on the child support. And if the mother was on drugs during the pregnancy, then too bad for the father (and the child of course) if it causes brain damage for the child. The mother will get even more child support to spend to support her drug habit.
