You are assuming that he saw her, or was in a position to see her so that he could avoid her. When I'm standing on the sidewalk waiting to cross I usually tend to watch for the light to change, and then I'll look for vehicle traffic that's not stopping before I head across the street. I'm not standing there with my head going around in circles in case somebody is coming up behind, or beside me that I have to dodge. If I'm standing still at a time and place where a person is expected to be standing still, I'd say it's up to the person moving to avoid me, no matter how they are moving.
