“As far as I can tell there is no constitutional bar to prohibiting the sale of sex for money provided the harm of the law doesn't grossly outweigh the federal government's objective in adopting it,” Prof. Craig said.

She said the prostitution laws struck down by the court “were nuisance laws. They were about trying to ensure that people in good, upstanding neighborhoods were not exposed to the unsightliness of sex workers. These laws were never about protecting sex workers.” And the court saw the harms as out of whack with the laws’ objectives.


Things are going to be changing and changing fast for all of us. If anything, this is the time for all of us to come together and start making plans for the future.

These are some changes for us that will affect the way everyone does business:

1.) Does this mean brothels will now be legal? 99.9% yes, but it also means they will be subject to regulations and standards. Things like fire and safety inspections.

2.) Sadly, taxes. However, it will ultimately benefit us to have a verifiable income for those who want mortgages, car loans, etc. Note though that if you have a schedule and prices posted and you mark certain spots as "booked" it could be a way for a Revenue Canada agent to determine your income.

3.) Licenses. Now the thing to watch out for will be whether or not you have an updated license, which will probably require STI/STD testing and employ a point system like a driver's license. There will still be a contingent who will operate without a license, but like driving without one, it will be illegal.

All of those things you mentioned allready exsist..
.Brawthal as persay have been operating.. under the escort agency liciens for over 15 yrs in some cities .. .like Victoria and Vancouver..

And escorts..have had to have mobil escort liceinses to work on there own or in agencies...

the next election.. and they will not beable to implament any new laws
that make prostitution illegal .. with out a refarendem..
Is this werthy of a refarendem.. or to . build an election plateform on..
I f they have viable solutions . to how yo stop .. drug addiction... care and support singke moms.. so that
tbey dont have to seek other income...
And address.. the sexuall issues of our society.. then .. maybe .we will see thd debates.
but then all the facts will come out. .Where as so far they just put out . the B S story . to make prostitution. an easy tardet... when sociolly it is very complicated .

The decition .. only delt with the . ambiguity of the law as writen and implamented..
not the issues. of what.. why .. and where..

The law was wrong.. according to our right and freedoms.. layed out in the constitution.
It also was wrong .. in light of .how it treated indaviduals at risice from. villace ...The police ignored the deaths of people..
The acknolages that the prostitution law as worded . lead indirectly to those deaths.
So it felt the obligation to correct it.

Now will people of canada . and goverment . come to the same decition..
.That is where the energies has to be focused.. . to change the attitude of those that think wrong

It is hard to understand what you are saying exactly -- but the election is not until 2015, and they have to come up with legislation before the end of 2014. They have a majority, and can pass any law they please, if they believe it is not in conflict with the Charter. There is nothing in the Charter that guarantees the right to purchase or sell sex. They do not require a referendum. Their official Party policy is to implement the Nordic model. Every statement they have ever made is that they wish to criminalize prostitution in some way, and they will do it unless they believe it will lose them votes in the subsequent election.

The only thing that will prevent it is to find a way to convince a majority of voters that it would be bad policy. That will require many millions of dollars. There is a time limit on this, and it will require sacrifice and hard work by advocates, and it will require funding from people like us to prevent it.

And...there is no guarantee that they will not remain in power. Harper has proved to be a brilliant strategist in the past. They have many lies that appeal to people of their ilk, and there are a lot of them. Trudeau could screw up big time, or they can "find" evidence of Trudeau having sex with a dead boy if they feel the need.

Sorry HQ about the problems you have with understanding what i was trying to communicate..
I think i have stated it clearly.. maybe not spelled it out that correctly.. But dont let that stop anyone from.thinking reationally on the subject..

pPostitution will continue to exist a under any law or ammedment to the law..
It just wont go away...

This case was about an adequate law.. which did not address the realities of prostitution and the sex trade
also did not address is being implemented in today's world.
Many people want to make the prostitution law.. into the law that protects all women from all things which is not possible.

violences against women general has nothing to do with prostitution. therefore in an anty prostitution law
will not protect then

traffic in another area they attempt. to solve I having prostitution legal.. or just the buying of sex..
most of this activity is already under ground and illegal.. and subject to laws that exist internationally

I think before we all start High Fiving each other, we ought to wait an see what the Tories come up with for the "Fall Session".

I am sure their religious right base have already got something cooking. Harper and crew are against anything they consider immoral and want to carve out a piece of history with his stamp on it.

I think you give Harper too much credit.. I can see where he is a moral person because he's a politician after all.. if you want to say that this person that has no merit here either...Because. all that makes them is self righteous.

If we continue to make that as a criteria for why will get new laws passed her at the prostitution I think you are over emphasizing that power over immoral self righteous people in government.
That has s already been demonstrated by some of the members of the Conservative Party.
do you really think they want to make their activities illegal I'm sure they use prostitutes just as much as we do.

Some how all this will be sidestepped for some greater issue.. and although many of us might a think the law is geered to wards prostitution it will not be.. nor will it affect business as usual..

of course we're going to have to wait and see what the reaction is general population is.

And as with any thing.. if you are that a fraid.. then get in all the pooning you can now.. cost be dammed.. because i guess you are willing to go with out when it is illegal :)

Supreme Court has thrown out all existing legislation and advised the Government to come up with a new model. Therefore its all a go "for now".

@ johnsmit - The Tory Base is full of religious nutbars, homophobes, anti 420, anti abortionists yadda yadda yadda. Do you really think they will allow a forward thinking sex trade legislation to merely be slipped by them without causing Harper some grief? Wanna buy some swampland in Florida?

Nothing's been thrown out yet. The judgement doesn't come into effect for 12 months to give the government time to come up with something far more draconian than the status quo. Enjoy your final year of legal pooning. After that who knows...

Most of the more highly educated conservatives/republicans I have known are against government interference in the lives of the individual and if they seem to be against things like prostitution, abortion, drugs and the like, it's only for the benefit of religious conservatives.

Can a man who has every AC/DC record and CD ever made really be against prostitution? Stephen Harper is an economic conservative before he's a social conservative. While I think the party will will make a fuss for the sake of PR, they will either ignore it and leave it as is or end up decentralizing the legislation and leave it up to the provinces.

Everyone is talking when,when,when, but for right now, it's a good position for us all to be in. You can prosecute, but because the law has been declared unconstitutional, what a waste of taxpayer's money that would be. So "fuck it" will be the general consensus until such time as the laws are changed, if anyone bothers to do so.

Basically, the fact that this decision has been made is a history changing moment for Canada right now in actual practice. And it will totally be like what I predict, I predict.

I called the onsie and a Hip-Hop/Grunge music and fashion style is going to be the next big thing too. Also Sedgeway will make a comeback, except it will be like a Roomba with GPS that will take you to your destination and avoid obstacles...or bump into them several times and then go in the opposite direction...

The goverment may be kept very busy.. trying to stem the flood of new constitutional chalanges..

It is about time.. there is a simple common sense rulely that can be applied against many asspects of some of Canadas ..out dated and ambiguious wording .. which allows for .arbitray inforcement in ways not intended that some law have been apply

We will see some big changes... hopefully to a more liberal and demicratic society..

There are far ranging effects on how the laws will be challenged. There will be some portions of the long law repealed. Those laws have nothing to do with prostitution but everything to do with our safety and choice.

The government may be kept very busy, trying to stem the flood of no constitutional changes.
It is about time. There is a simple consistent rule that can be applied against many aspects of some Canadians. With outdated and ambiguous wording which allows for arbitrary enforcement in ways some laws should not be applied.

We will see some big changes, hopefully leading to a more Democratic society. More liberal.

Like my rough and tumble American cowboy grandfather (who, as an aside, wore knee high moccasins with all formal wear and once reattached his own thumb with a sewing needle) I am an old school Republican in the truest sense of the word, which was originally started by anti-slavery activists and based upon the ideals of entrepreneurial spirit, land ownership and higher wages/lower taxes. Don't need or want the government to be my nanny, because guaranteed they'll fuck it up. Every person I know who works/ed for the government agrees that the system they work within is inefficient and could likely be handled better by private industry.


This said, in keeping with non-welfare state ideals, working girls are just that, working!!! We are women who want better lives for ourselves and our families and we are willing to put the effort in to do so. It is hard for any decent woman with a family to work no matter what she does. It takes time away from your most beloved but you do it, because you need to take care of yourself and them. Every woman I see standing behind the counter at McDonalds, sweeping out a bathroom, giving me a pap smear or selling my house is someone deserving of my respect.

Club78 - here on PERB you're preaching to the choir. We all know many SP's out there as three dimensional human beings who work hard and excel in the vocation they have chosen.

However the PERB choir doesn't make policy at CPC conventions. Good god-fearing upstanding rural folk whose idea of adventure is buying something from the ethnic aisle at Superstore. Those are the folks who make Conservative party policy.

And they don't have a three dimensional view of SP's. Their belief is that you all are controlled, manipulated, trafficked, disease-riddled, broken women freezing on a street corner turning tricks so your pimp will give you another hit of low-grade heroin. And if this abomination isn't stopped, who knows whose daughter is going to get caught up in it and have their life destroyed.

These people are an enemy, but also they're not because, godluvem, they care. But caring people of all political stripes are motivated to do something to right a wrong no matter how much they believe in small governement. And believe me, they'll show us their love in the form of the Nordic model.

Maybe we should all form a PERB choir and go sing Christmas carols to them so they get to know us. We're just the evil enemy that tears lives apart right now.
