This is absolutely true. I got written up for running a Red in Richmond. It was barely yellow yet this officer wrote it up as a Red.

I went to court and plead Not Guilty. The Judge automatically started lecturing me about contesting the judgment of an RCMP officer. I accepted that but asked to view the officer's notes which he had not brought with him. The judge tried to reschedule but I protested that I had to take time off work and it was a huge inconvenience to revisit this a month later because I would be travelling etc. Case dismissed.

I had a very similar experience disputing a red light ticket in Surrey (Richmond courthouse though). I argued that I should have been cited for running a YELLOW light under the Motor Vehicle Act...the cop had EXTENSIVE notes, since I'd made it clear I'd contest the tickets. Unfortunately for him, the wording in his notes proved my point for me. I also got lucky in that I was the fifth contested ticket by the same cop in front of the same magistrate, and she'd completely lost patience with him and his sloppy note taking & ticket writing. I didn't have to say a word in my own defense; case dismissed.

cops and judges have days they call 'quota days' where they have to fill their quota of moving violation tickets so the municipality gets the amount of revenue they budgeted for the month

just don't ever challenge a cop about their quota unless you want to eat a knuckle sandwich!!

Maybe start mounting an HD video camera on your car, like they do in Russia. It's hard to argue against video evidence... and judges don't like ANYONE lying to them. Especially cops. Of course, that can also work against you, if you do something wrong...it's on camera.

That reminded me of this video.

Good idea, CJ!

I wasn't there but a few friends went out at Christmas and ended up going through a Road Block. They had a DD so they felt pretty good about getting through without any consequences. One guy in back seat was videoing it with his phone. This incensed the cops who tried to take his phone. They did make him erase the video and his choices were pretty limited since he was pretty drunk and they were going to hit him with being drunk in a public place.

I think if I were to video something like a discussion with a Cop, I would mount one of those Go Pro's in the back seat area. They are pretty small and can be controlled with a remote.

back seat or front dash... no matter what a cop says, they don't have the right to force you to delete a personal recording device. Your car is considered public, which is why you can be arrested for having open alcohol in it. In public, you have no reasonable right to privacy... the only thing that might be an issue is commercial use for public broadcast (which is why waivers are required).

That cop intimidated your friend into compliance. What your friend did was not illegal. As for being fined for being drunk in a car, returning home as it were, the cop was being a dink and really had no right to do that... barring open liquor in the car. Their only concern should be the blood alcohol content of the driver.

Just the messenger CJ. Yes they were intimidated and yes they were very drunk and the thought of spending the night in the tank weighed on their minds a lot more than keeping the video footage.

They did not have any open liquor and were on the East Side of Vancouver when they hit the road block. Now I wasn't there but given the guy I know with the cell phone it was most likely he was being a smart ass and the cops weren't giving him anything to take away via cell phone video.
