Yes.. we know the difference between SWAN the non profit and Swan Lake. The discussion was around how the issues with Kash and the bylaw enforcement is impacting the AMP's Swan Lake in particular. SWAN the non profit only came up peripherally as they are trying to positively affect the situation.

I am confused if this is supposedly a bylaw or criminal.

Regarding clothing in 2004-2005 era a Brampton massage parlor was cited by bylaw officers for violating the opaque clothing bylaw. The massage parlor won since being naked is not against criminal law. Now under C36, although I may be out of date but against escort agencies etc, the sexworkers won 3 cases and lost one at the Superior Court of Ontario level. As far as I know, the Crown has never appealed to the Supreme Court of Canada.

Remember, the prior law against incalls (bawdy houses and agencies - living of avials" was firmly struck down by the 132-page ruling of the Ontario Superior Court and upheld by the Supreme Court. It made clear under the Charter of Rights that the law violated the safety of persons' provisions since being illegal made it clearly more dangerous. Outcall was legal under the old law.

I realize this is BC, not Ontario, but the arguments should be the same.

When C36 was enacted, the police in Vancouver, Toronto and Montreal issued press releases basically saying there would be no change in enforcement basically means only going after underage and real trafficking cases or illegally in Canada. I am less updated on the BC situation than I am in Toronto and Montreal. So others here may have better information.

The C36 arrests were in smaller, more conservative communities in Ontario, not Toronto. Just like Richmond may be more conservative than Victoria. I recall the days the many incalls in Sanach (sp?) were warned by the Sheriff (I didn't realize you had Sheriffs) to move to Victoria after Saanich wanted to crack down - this was pre C36 which was the result of the prior law being struck down since violated safety of persons in the Charter.

In the early days, the agency incalls were welcomed in Victoria, including one on the main street downtown. Police visited, but only to be sure the gals had paid their annual license fee were adults, etc.

I’m not 100% but spoke with the Richmond News reporter on behalf of a certain AMP and I asked not to be quoted so I dont think he published what I said coz it’s not on the record.
The City or Kash since he’s ex police chief are using these big words ie organized crime and human trafficking is just trying to fear monger the public that they’re doing the “right thing”, which is to increase penalty for ladies or AMPs whose not following city bylaws.
Imho it’s just city’s way of a cash grab since they made $100k last year issuing fines for workers who are not properly registered with the city from all industries and that it’s easy for AMPs to cross that line.
1. You’re not supposed to cover the windows, which is okay in the city of Vancouver, but since city of Richmond won’t allow it therefore, Cha Ching bylaw infringement - Fine

don’t you find it ironic that they’re only targeting licensed joints? No mention of the apartments even Kash openly said that there’s a website that these joints - AMPs are advertising for sex openly (Kash’s words) and yet they have all this info and knows of Leolist but doesn’t point the finger that way toward those operating out of apartments , why is that ? It’s just all for show to show they public that they’re doing public work. Yet they gave 2 licenses to Montessori’s around SL when it’s been around since 2000.

Well then, maybe its time for these establishments to consider relocating outside of Richmond? For example, towards mass highrise growth areas such as Lougheed mall, metrotown or Brentwood mall, Victoria drive, Commercial drive area? I'm sure there are plenty of vacant places elsewhere to move in?

Not gonna happen , if Tina moves out of the city of Richmond to another area she will lose her licence and will have to get another .

Arrests are never 👎🏻 made vis a vis bylaw infractions. Simply fines. It’s exactly 👍🏻 the same as getting a parking ticket. If, as or when you get too many parking 🅿 tickets 🎫 they MIGHT tow your car 🚙 in order to ENCOURAGE payment of the ticket 🎫

Well if it’s the LE they can ask you to identify yourself, and at that time you have to show ID. Richmond is actually known for having walkins from LE in the past. I think they’re not just worried about the trafficking but also the immigration scam as they want to make sure the women have proper visas and not working illegally so it’s smart on their end.

Immigration and visas shouldn't be a local LE issue thats for CBSA and IRCC to deal with. I am not aware if LE in Canada have the rights to enforce those rules (atleast I couldn't find any answers with quick online search) but I would assume they wouldn't.

On the point of showing ID, the cops can ask you for it and you can refuse unless you are driving or cops have a legitimate suspicion that you are involved in a crime which can always be contested.

Any violations would be such a small fish addition to the city coffers. Tina can have the ladies all switch to uniforms that can be easily taken on and off and since the front door is always locked their is plenty of time for everyone to get themselves sorted and door windows uncovered. Easy peasy.
