Is anyone familiar with labour law? If so, how can the NHL Players Association claim to be a union in BC and Quebec? I thought a union did collective bargaining, but players in the NHL almost all have agents who bargain their players' contracts individually and separate from every other player. In every other business I know if you bargain your own contract you are out of the union. The PA seems more to be lobby group for certain collective principles and contract clauses.

up until 3 months ago, the NHLPA was NOT CERTIFIED as a Union in BC/Quebec. they made application to receive their proper ceritfication under the respective provincial enabling legislations once it appeared that the League might seek to declare an impasse with the NLRB in the US.

they had 2 hearings (one in each province) to obtain legal status as a union and both provinical union boards deferred the decisions to make a full written decision (ie. stalling and hoping the strike would get resolved so they don't have to make a real decision).

the reason is that if they get certification in BC/Quebec, the 2 most Union friendly work places in Canada, the provincial statutes forbid the use of "scabs" and replacement workers.

so you boys in BC would not be able to have scab hockey without the NHLPA seeking an injunction first. also, the league would be risking damages if it proceeded with scabs.

that is a basic summary. as of right now, the NHLPA is NOT officially recognized under law as a union under provincial labor laws, only in the US with the National Labor Relations Board.
