Remember that California mom who sued Nutella maker Ferrero over misleading advertising that made the addictive and gooey chocolate-hazelnut spread seem healthy?

Well, her lawsuit was awarded class action status, and the New York Daily News reports that Ferrero has agreed to settle for $3 million. That works out to be about $4 a jar or less, if you're thinking of making a claim.

Quick recap: as we reported on the Shots blog last year, the trouble began when Athena Hohenberg realized that the Nutella she'd been feeding her 4-year-old daughter was "the next best thing to a candy bar," according to court documents. Hohenberg says she was taken in by ads and product labels that claimed Nutella was "healthy" and "part of a balanced meal." When friends eventually pointed out Nutella's high sugar and fat content, she sued Ferrero for deceptive advertising.

At the time, many commenters were astounded that anyone would consider TV ads a reliable source of nutritional information. Indeed, it only takes a glance at the label to discover that Nutella's main ingredients are sugar and palm oil.

Now, to be fair, many of us don't really look at labels too closely, but with glaring numbers like 21 grams of sugar and 200 calories in each 2-tablespoon serving – and half of those calories coming from fat – you'd think that might register with a shopper.

Naturally, Ferrero's ads don't mention the fat or sugar. Instead they talk up the "simple, quality ingredients like hazelnuts, skim milk and a hint of cocoa." Apparently, that gave Hohenberg's claim enough weight to convince Ferrero to settle. The company now says it will change its nutrition labels and its advertising, in addition to the $3 million payout.

Under the terms of the proposed settlement, anyone who purchased Nutella in the last few years may join the class action. Each claim will pay out up to $20 – that's $4 per jar, on up to five jars – or less, depending on the number of claimants.

For the legal geeks keeping score, technically, there's two class-action settlements — one for California and one for the rest of the country. And they were reached in January, although both settlements aren't really final until the district courts give them the OK at "fairness hearings" in July.

I for one think it is about time someone took these companies to task for selling crap and making it appear to be a healthy item. Other examples are things like Sunny D (might as well give the kids a bottle of Coke with a vitamin C tablet in it), 98% of all granola bars (more sugar and crap than most chocolate bars), fruit roll ups and fruit snacks, etc.

Yes, they are bad boys for promoting a product in a misleading manner but, hey folks, it's our responsibility to do what we can to ensure our own well being.

If all the companies who mislead the public were held accountable for their marketing, the legal system would be jammed. Not to mention agencies like the FDA, Canada Food Guide... (Wheat? Dairy? Really?)

Don't get me started. But good on her for taking the company to task. Perhaps the others will think twice.
Apparently literacy is not one of her assets. Anybody who actually takes the time to read the labels and understand food nutrition will know the ads are all false. Palm oil is the second item in the list of ingredients. That should be enough to know that Nutella is not a healthy choice.

the problem lies in the fact that most oils are not clear when pressed. in order to remove the small particles that make them cloudy, you have to clarify them by various processes including flocculation (fining), filtration, centrifugation, flotation, refrigeration, pasteurization, etc. many of these processes work much more efficiently if the oils are heated, and of course the higher the temperature, the more clarified oil you get. the problem is, the high temperatures change the makeup of the oil by breaking down the long molecular chains to much shorter ones, rendering the oils into an unsafe form for consumption

olive oil is one of the few types of oil that can be filtered cold, hence it's excellent reputation as a condiment or food additive. it's problem is that it can't take much heat before it breaks down and starts to 'smoke', so it can't be used as a cooking oil. sunflower seeds, safflower seeds, rape seeds (canola), and others do not require much heat at all for extraction or clarification, and have a vey high 'smoke' point, so they can be used safely for cooking oil

The key to the case is misleading advertising. In the US, courts believe that intentionally misleading people deserves damages. Apparently not everyone thinks that way.

you want something good thats good for you? coconut water. low in calories (40-50 per 250ml), quenching and loads of vitamins. just stay away from the crap they sell from thailand in those tall boys with the floaters of coconut pulp thats just sugar.

As far as good oils are concerned top of the heap are the olive oils and grapeseed oil. Canola is ok but is still highly processed.
like i said earlier, there's nothing bad about palm oil. the problem is how they clarify it... if we humans didn't require our oil to be transparent, we could eat a much larger range of oils quite safely - i mean monkeys eat palm nuts all the time and it doesn't harm them at all - it's getting the cloudiness out that fucks it up

The problem I see with these lawsuits is the fact that it makes it easy for people to blame OTHERS for their own problems. Everyone should be accountable for their own actions. Blaming cigarette makers, McDonald's, and other companies for the poor decisions you made doesn't help. And who is benefitting fro these lawsuits? Big law firms. It's time people take responsibility for their own action and stop finding someone else to blame their problems on.
