This is a case about when assault starts and self-defense stops. I think if the accused had stopped hitting once the guy hit the floor, he would've been okay. But in the heat of a fight and the guy came after you with a weapon first, easier said than done...

Could he have claimed fetal alcohol syndrome and native background as an excuse for his actions?

When defending yourself in a fight, especially when it's not of the school yard variety, you need to make sure that your attacker can't get back up and continue their assault on you, otherwise you could very likely be the one in need of 5 months of rehab.

That being said, he could've just not gotten out of the car, and told his gf to drive off.

If you are unarmed and now your are armed, who's get the advantage? In this case, Truong had been unarmed, Lucic's friend still beat the crap out of Truong. This totally crosses the line of self defence. Remember, both of them are normal citizens! So, Lucic's friend is responsible for that part! So, yeah, I support the judge on analyzing the arguments!

Now, I didn't read Lucic's letter. But if his letter to the court is to say that his friend really acts out of self defence, then he's a total idiot because obviously his friend is not, after unarming Truong. Supporting your friend by saying what he does is right and acutally is wrong, this makes you a total idiot!

Just my opinion on analyzing facts!

This may be a little complicated for you. What you quoted was my response to RC's post so you are taking what I said out of context. And Lucic's letter was more as a character witness than anything else.

LMAO.....I havent read his letter either, but i assume it is about his friends character. Not his view of an incident he never saw happen, and would just know what he was told about it by his friend. Man you really are clueless.

In sentencing submissions Tuesday, Crown counsel Gail Banning called for a sentence of between 18 and 20 months in prison followed by a year of probation.

She said the aggravating factors included the fact that it was an assault on a motionless person who was laying on the ground and that there were blows to the head with a weapon.

Banning also said it was significant that Papalia lied during his testimony and that he fled the scene following the assault, without offering any medical aid to the victim.

So the Crown was requesting up to 20 months for this assault. How does that compare to the 9 to 12 months the Crown asked for in the case of Del Louis assualting bus drive Charles Dixon?
