Well, unless some legislation has passed that I haven't heard of, YES, it is legal to download 'for personl use' only, in Canada. "Personal use only' means you cannot turn around and distribute the mp3, that is mass produce it, sell it, charge for it etc. The copyright ruling stated that it is legal to make a copy of copyrighted works, regardless of source, including p2p, as long as it was for personal use and not for distribution.

However, even though there was mention of a new legistaltion against merely putting these mp3 files in a shared folder, without advertising them, until that legislation becomes law (it may have, I just haven't yet) it may still be legal to share them as well. But, before you share, you might want to confirm that it's still legal to merely put them in a shared folder.

Maybe someone else here has updated info on this.

just downloading for my personal use....

It would be nice to keep the way it is, but CRIA is fighting to have that law changed, which thus far has resulted in that change about sharing files. All these years they've been collecting that levy on cassettes, cdr's etc. and thus far have given virtually none of what they've collected to the artists. They instead have squandered almost all that money on themselves and lawyers and court cases so they can raise the levy and make even more money, and change the copyright file sharing laws. If I was a recording artist I would be organizing a class action suit against CRIA for all that levy money that's supposed to go to the artists.

Eveyone above has given you competent advice. In strictly legal terms, filesharing in Canada is not yet illegal. However, there is pending legislation to change this. So, download all you can now, any new laws aren't retroactive :)
