Don't know if it's suitable to ask this here but going ask anyway, I forget where but I do remember read an articale about incall are illegal due to no brothel law in canada is that true?
Don't mean anything just curious about very complicate canadian prostitution law.............

not really the case. An Sp has the right to use her place for business purposes as the trade is technically not illegal. Does she have the right to rent a seperate place and use that, probably, but don't know for sure. Having more than one gal in the place makes it illegal I beleive.

As the current prostitution laws stand, bawdy house is still considered illegal; which is where ONE or MORE ladies use the space to ply their trade. However, the Federal Laws have been struck down by the Ontario Supreme Court. They are in current 'stay' for a year so the federal government can amend the laws on a federal level.

In the mean time; it's my understanding due to the up and coming change in the Federal Laws, there is no prosecutor that will convict a lady who is working within her home. *Dont take my word for it*

Bylaws for each municipality will likely not change. So instead of possible federal conviction a lady must still be wary of large bylaw fines.

It is my understanding that renting a hotel to 'work' is a grey line as she does not live there, or answer the phone for her clients to come by. Cell phones are still considered personal therefore it is my understanding that they do not play into use for service, ie: under public solicitation laws.

I guess that's the case never heard any news about people got arrest because of the incall.

If you research it, you will find that at least in Vancouver, no solo sps have been arrested for this. But technically/legally, there is no difference if an sp works alone out of an apartment or hotel room incall, it is the same. What LE doesn't do, tho is set up an intensive 3 month investigation on a solo sp. They will do it where there are multiple sps (any micro, asian or non-asian), especially when they can also nab the owner for trafficking because the workers are on tourist visas.

If they shut down an incall for someone who is working solo but legally, she just sets up to work another way. They don't have any other laws to charge against her. To investigate and charge her, all they have is the bawdy house law. She isn't any more or less at risk if there is just her alone or one or two others using the same location. It is all illegal.


if they shut down a 10 person set up, and can deport 8 out of 10 of the workers and owners, charge with living off the avails, bawdy house and trafficking, that is a better use of the man hours of investigation. If they go into an mp, they have the entire business to shut down or fine. They simply don't see a pay off in tracking the independents.

That's right, hotel rooms are considered private property until you solicit or transact for sex, in which case public solicitation laws apply.

One's own residence can legally be used for sexual-monetary transactions.

Where it is not one's own residence, you need to get an appropriate license from the city. For example, licensed escort agencies.

When you say 'one's own residence" I assume you mean to say 'the client's own residence'. All outcall services are legal, the sp coming to you. An escort license is not a license for prostitution.
