I think it's more a matter of conscience... how do you define "getting away with it"? If you could remove the legal, societal and personal moral repercussions, then almost anyone would do it... of course, we'd be little better than primal animals or robots at that point. Take away everything else, strip a man (or woman) down to their core values... that's where you'll discover who's a killer at heart and who isn't.

If you're talking about revenge, even the most hard hearted and wronged being might step back from pulling the trigger on someone (although beating them to within an inch of their life might still be on the table). Unless you are a true killer (sans remorse), it's doubtful you'd premeditate to take a life. Crimes of passion or insanity, well, we see those every day.
