ICBC estimates 16,000 claims last year were at least partially fraudulent.

What I don't understand is why these people just seem to get claims refused, or maybe get asked to pay back settlements, but I've never heard of them being prosecuted criminally.

Anyone know if it ever happens?

That's because they don't do any forensic investigation to make a sound and convincing decision. I recently had a claim and they just don't do any forensic investigation and judge me 100% responsible for the accident. So, i appeal.

So, if you bring it to the court, then ICBC will have to provide forensic evidence.

When they only used the ICBC Claim Centres, they would on occasion bring in Police officers for repetitive or suspicious claims. There was a dramatic decrease in fraudulent claims as a result.

Now all the claims are in the hands of body shops. They think they are saving $ without the claim centres and fraud is on the rise.
