What happens if you go through the Examination of Discovery phase, where the court reporter transcribes what is being said.

This happens months, or even years before the scheduled court case trial date.

If the case is settled before the court case, will those Examination of Discovery notes ever be able to become public, or will they be sealed and private?

Usually the transcripts will just sit in the lawyer's files, likely for at least 10 years or so until it gets cleaned it out for storage. Not sure how long court reporters keep their tapes though.

First of all, it's Examination for Discovery. Second, it's impossible to give you answers about the particulars of your case when all you've given us is tidbits to work with. Case Law is complex enough as it is. I could sit here and spew out lots of generalities which isn't going to assist you in any way. It sounds like there are some salient details that you fear may become part of the Public Record, and yes most everything does, unless there are some very compelling reasons to prevent this, and this would be known in the early stages. Your attorney can inform you of this. Settlement does not affect or alter the privacy aspects of a case unless both parties agree to it. That's about all I can tell you, from the little you've told us.
