How to Give a Police Statement on an Assault if you're an SP

I'm looking for advice on how an SP can give a police statement without self-incrimination. I had a client recently assault and bear spray me. I'm somewhat certain that under Canadian law, there's something that says that a victim (me) is immune to criminal investigation.

I'm not in this for revenge. I read a lot of Eckhart Tolle and I believe my attacker's pain body got the better of him. Or perhaps he flashed back to some feisty woman in his past that he projected on me. People are unconscious and know not what they do. Basically, I'm compelled to do the right thing and give a police statement to prevent this individual from doing the same thing to other SP's or other people in general. But I'm torn with respect to how to state the facts.

The constable says I have to tell the whole truth because my statement and testimony would be the evidence. But how do I say it? Do I say I provided COMPANY for X $. And then engaged in other pleasures as a result of me wanting to? Ie. some sort of disclaimer type wording similar to what other SP's write on the bottom of their webpages? I'm guessing the cops will ask if I engaged in sexual relations with this individual. What should I say?

Do I have to provide the intimate details of our encounter pre-assault?

The constable told me that prostitution is pretty much legal in 6 months so I don't have to worry about being implicated.

But what if one day, down the road, I'm in a car accident or some other incident in which the officer looks up my history and then treats me with prejudice based on my old testimony for this assault. Currently the cops can only speculate if I'm an SP or not, but my evidence may be construed as a direct confession to it.

What are the potential consequences of providing a police statement as an SP?

I'm not too worried about him re-attacking. My support network has uncovered where he works and lives. He is also a gang member. He doesn't know where I live because I keep incall and living quarters separate. However, if I provide a testimony in court then won't he be able to find out my real name and possibly hurt anyone that I'm associated with?

Guess I was too white washed growing up to take any criminology in college like every other brown person. :p Big mistake. Crim knowledge would really help me now. Ethnic people need to protect themselves from racism of the establishment by knowing the law.

Because of the assault, I've finally decided to begin the process of quitting. I'm quitting soon btw! People have been telling me to quit for a while now but I've been waffling back and forth.

I was "present" enough to deal with pooner lies and bs without total soul depletion so I stayed. The assault was a wake-up call that the dinero is not worth limb or life. I was lucky to keep my life. I'm not a drug addict who needs to feed her habit nor am I a foresaken mother.

Fortunately, I have a good support system for the time being. But then what? How do I get back into the job market after leaving the "socially unacceptable" job market. I don't even want to be an "employee" anymore. Some sort of self-employment is my cup of tea. How do I deal with gaps in my CV if I do apply? Guess I'll just have to say I did reception for a relative or really own up and say I shined bolts for the Queen. ;)

I should think you don`t need to worry about too much as prostitution is NOT ILLEGAL in Canada. Be as honest as you can with the investigators and they will help you.

I have a feeling you were dealing with the RCMP and not the Vancouver Police. It seems the VPD is a little more open about matters having to do with SPs and there is someone who specialises with problems SPs encounter, I think her name is Detective Linda Malcolm. But first of all, if you need advice, contact Susan Davis who is on this board and she WILL help you with any legal problems, if any you may encounter with the police.

There is a lot more support out there for SPs than you may think. We are not in the US where prostitution is illegal for the most part and just admitting to being one will incriminate you. So don`t worry.

Sounded like you had another police officer that does not know that pristitution in legal in Canada..
I honestly wonder what they have been telling tbem all these years

Any way the client is paying you for your time... What two consenting adluts. do in the privite.. in a privite residence or hotel .. is there business.. and he is paying you for services that are legal under the law ...

So you can be totally honest. about any pay for play... just not buying or selling drugs

Sorry to hear about your horrible experience.

There is a term for what happened to you and that term is "Aggrivated Assault". And maybe aggrivated sexual assault and attempted rape.

I remember when I took Law in high school, uhh, a few yeays ago, we studied this case where a prostitute had been raped. The defence argued implied consent and mitigating circumstances. Ultimately the judge found the defendant guilty saying a prostitute was entitled to the same protection under the law as anyone else. In short, no means no.

I'm sure that none of us have forgotten that two sex workers were murdered in New West last year. Remember also that the Supreme Court has stricken down Canada's anti-prostitution laws giving the government a year to come up with new laws.

The point isn't that the sex business needs to be eliminated. The point is that it needs to be cleaned up. Assaults like this need to end.

Talk to a friendly female lawyer who practices criminal law. Get some details on precedents that apply and what to expect when you file a complaint.

You should prob file your complaint with a female member of the Surrey RCMP. I'd be surprised if she is anything less than completely sympathetic to you.

Oh, and don't worry about returning to civvy life. Keep your past as private as possible of course. But if anyone does find out about or suspect your previous career the only ones to judge you will be prude church-goers who haven't been laid in 20 years.

Oh my goodness, I am SO sorry that this happened to you, and SO glad that you are OK, and handling the situation with such reverence.

Have you contacted Susi, as she may have lots of information on this, so you don't have to wait too long to finalize your report/statement.

I'm also glad that you have a great support network, as that is crucial in times like these. Thanks for reaching out for answers from this world as well. Meanwhile, I also think there are a number of ladies here who have professional careers, and can share private information on the process of retirement and finding a new vocation.

don't make apologies for a man that would do this to a woman either, there is no excuse, nothing that happened in his past, none of that matters when he makes the choice to assault a woman, it is inexcusable and he doesn't deserve compassion at all

Assault is assault... the circumstances of the assault don't particularity matter, as NOBODY asks to be assaulted.
