i heard that you can sue and have people charged if they have hiv and are known in the system to have hiv they can be charged with attemped murder some articles online are saying people can be sued for passing herpes too !??? is this true?

I don't think its attempted murder, but there are a number of guys in jail now but I think the charges are assault.

So, yes, you can go to jail if you know you have it and pass it on, especially if its proven that you have it and you deny it in order to get unprotected sex from your partners. I think that someone with herpes was also charged recently, or at least his information was published as a warning since he seemed to be deliberately and maliciously seeking out unprotected sexual partners without disclosing his status.

On 4 April 2009, Aziga was found guilty of the two counts of first degree murder as well as the lesser counts. The current precedent in Canada stands as any person who has HIV, fails to disclose the fact to their sexual partner, and does not take some sort of protective measure (such as condom use), is guilty of aggravated sexual assault as per R. v. Cuerrier and subsequent cases. Aziga was convicted of first degree murder since under Canadian law, any death as a result of aggravated sexual assault (two of the women died as a result of the HIV infection received from intercourse with Aziga) is automatically first degree murder as per section 231 of the Criminal Code of Canada.[7][8]

If the HIV infected uses a condom, i doubt it. Maybe a lesser charge,
if the cover failed or came off.

this is a difficult disucssuion for our community but the truth is you can never be too careful!!and it is never acceptable to hurt anyone.

i knew a young man also, who had herpes. he went around fuckin women left and right unprotected in an almost malicious way...who am i kidding! it was totally malicious...anyway, he was kind of denial and i don't know... i can never understand how people treat one another...dang it!

I was referring to the other person mentioned. So if someone has HIV but does not reveal it,
then it is not a crime to have BB sex, as long as the other person they had sex with has stated
beforehand that they have HIV, or in fact does have it, whether they know it or not.

No. I think it is pretty clear that the person with HIV has to disclose the fact to their partner -- they can't just go ahead and do bb just because their partner told them that they have HIV. They too have to say it.

I am not sure what you are trying to get at with your posts. Are you trying to figure out how you can get bb activities from other people knowing that you have herpes, syphillis or HIV without having to tell your potential partner first? It kind of sounds like you are looking for an out.

It's ok tho, I think these laws only cover Canada and the US. You can feel free to spread your lovin diseases around to the bar girls in Thailand or whatever.

The exception i was referring to is a case where both partners have HIV, or at least think they do.
If each of them is infected, then what crime has been committed if they have BB sex, or how can
they cause harm to the other with regards to contracting HIV? Even if they didn't disclose their
disease to each other, i don't know how the law could punish them.
