just looking for your opinions,I was pulled over in Richmond by the RCMP.I had a little bit of weed in the trunk,they asked for my info,and the others in the car,one guy in the car has a warrant for some charges.I was wondering,what right do i have if the RCMP,wanted to search my vehicle,to say no,and at the time i was not high or had any drinks.

If they ask to search your car, to the best of my knowledge you could have been a dick about it and made them get a warrant, but to be honest if you had a little amount they won't charge you anyways, unless you make a problem for them. If you get pulled over with less than 4 grams why not just admit it and get it over with? They don't care if it is a small amount, unless you make them upset then they could charge you with possession for even a stem!

As for your friend who has a warrant, that is his issue and not yours. AFAIK, your fine on that front...

You have the right to refuse to answer any questions and to the search unless they arrest you, in which case, you have the right to consult a lawyer before answering any questions. Although they may have enough probable cause to search your car anyway because of your friend's outstanding warrant. Any lawyer in the house who want to elaborate?

How much is "a little bit"? I believe the threshold is 30 grams (not sure where the 4 grams rule come in as per anonanon above).

I think the main issue is why u were pulled over in the first place, if they had probable cause to pull u over in reguards to any suspicious activity, they dont need a warrant to search your car and have that evidence admisable to court. but if you were in fact pulled over for a traffic violation then u have the right to refuse a search unless a warrant is provided/issued. Either case, that little amount is nothing really, if it was, you would get more than just the officer writtinng down your info. These points were what a friend told me recently cuz he was in the same situation and afterwards talked to a lawyer. Hope it is close to the actually fact.
