Got an off-leash ticket the other day. $250! From a traffic cop. I was on my morning run with a friend who looks like Conan the Barbarian in Jordan gear and my most obedient & smart border collie as we jogged right past a motorcycle cop who decided his time would be best spent giving me an exorbitant animal by-law ticket. Fucker. It was 9 am, i usually go much earlier but Conan insisted on a pre-run bed warmup..how could i say no? I attempted to ask the pint sized officer (my beefcake friend later commented 'small man syndrome') if i could go back home & grab the leash & tried further to reason with him but he kept putting his hand up, dismissing me. Little did he know he was dealing with Very Veronica . So i got my ticket, told the guy he was an asshole, went back home & called his supervisor who seemed receptive to my complaint.

So now i'm wondering, should i dispute the ticket? I know i was wrong but it seems to me a $250 fine should only be imposed with problem dogs (or rather bad owners.) Also, if the officer doesn't show up, does the ticket get thrown out? And if he shows up, i've been told odds are the judge will halve the ticket. Anyone?

VV, I would dispute it even if you know your wrong. I've known people along the way that have disputed they're ticket and won if the officer doesn't show up. And if he does show up, give an honest statement about of you feel about it and you get a much reduced fine.

$250 is way way to much!! I would dispute it just to the fact of the ticket price.
That price is unjustified!!!!!!!

When you called his supervisor, he probably knew what address you were calling from and, assuming you are the owner on the title of the address, told you what you want to hear.

Expect a discount but not by much, if you plead guilty and pay the fine.

Either that or chances are he WILL show up because he's either a pooner on PERB or has a buddy in vice, and probably knows you by name and face...plus you called him an asshole after the fact. And that's why he gave you the ticket to begin with because you're right, that's a bit steep for a first-time municipal dog offense. Something strange about this case...

Just like back in the day of speeding traps when camers weren't available like today. If there's no proof or tracking...you win.

Stop being so bloody cheap!!! You charge men up the ass to have sex with you, but you won't pay a by-law ticket from a Cop just doing his job?!?!

Most often, the courts will take the PC's word against a citizen's, barring any concrete evidence to the contrary. If no evidence is given, then the PC owns the word.

It's not like you say, that they need a witness to substantiate their claim in a case like this and the presence of non-participant witnesses who are willing to participate is almost surely null--and will annoy the judge.

If there is a witness then it may sway to VV, depending on the witness. But this is not a serious criminal matter, nor a serious matter, for that matter...I forgot what matter I was on.

So the likelihood of your scenerio, SOMF is almost zero. If she has enough money and wants to argue the case in court on principal and have the witness in court, it may cost a pretty penny along with lawyer fees...but why would she want to? No precedent will be set in the process.

Pay the fine VV, and keep shit off our streets. There are enough of us NON-dog lovers around here to also have to put up with the intermittant doggy-do on our streets, let alone the more familiar type from our pan handling, leechers and lurkers night-crew!

Since I'm a layman, my opinion is not worth anything in a court of law. But my layman's interpretation of Vancouver's animal control bylaw is that your dog doesn't have to be leashed if he is under your control at all times.

If a dog is off its property, not leashed and not under the immediate charge of a responsible person, it may be impounded and/or the owner or keeper ticketed for breach of the Animal Control Bylaw.

Pay the ticket, jogging with your dog off leash its not under control; its convenient for you. I'm not saying your dog was doing this but I've seen many joggers dogs stray or lag very far from their owners. Joggers also tend to miss picking up after their dogs. Bylaw and Police often hit an area hard, with no first offense warning, when complaints from others (ie park or trail users) about aggressive, running loose, not under control dogs or dog shit. You tend to whine when things don't go your way...maybe Conan will pay it for you?

How about...just for fun....turning to the judge and saying...."with all respect your honour, I completely disagree with all this. It is tiring me.."

Then, write out a cheque for $2,000, hand it to the bailiff, and leave gracefully with a smile.

I believe you have an opportunity to challenge the ticket if you can prove that your dog is 100% under your control without a leash.

Few dogs are trained this well.
