A one-month jail sentence has been handed a 20-year-old Surrey, B.C., man for his role in the Stanley Cup riot a year ago.

Emmanuel Alviar was also given 16 months probation and ordered to perform 160 hours of community service after pleading guilty in March to participating in a riot.

In addition, he must send apology letters to Vancouver's mayor and police chief.

Alviar kicked garbage at a burning vehicle, helping rock another car and used a stick to smash windows in the Telus building during the violence last June 15 after the Boston Bruins beat the Vancouver Canucks in Game 7 of the Stanley Cup finals.

The Crown was asking for four months in jail, while Alviar's lawyer was hoping for a conditional sentence, which would mean no jail time.

But in handing down the sentence, Provincial Court Judge Rich Harris said general deterrence is needed in a case like this, considering Vancouver has suffered two Stanley Cup riots.

Alviar's lawyer Gary Botting defended the request for the conditional sentence, noting his client had no prior criminal record.

"Basically that would give him the chance to make recompense in the community, whereas in jail, (that's) not going to happen," Botting said. "Too often we put people in jail, because that's the first response."

Downtown Vancouver Business Improvement Association Executive Director, Charles Gauthier, said the sentence is in line with the organization's expectations.

He said he doesn't feel sorry for those who go to jail for their roles in the destruction.

"Balance that with the victims who, you know, not only had property damage, but have been traumatized by this event," he said. "Many of them have made the decision not to work downtown anymore. Not a lot, but we are hearing some of those stories."

Seven other people have pleaded guilty to various offences including mischief, break and enter and assaulting a police officer as a result of the riot, in which hundred of people broke windows, looted stores and set cars on fire.

Police have recommended close to 600 charges against about 200 suspected rioters so far.

The Crown, which makes the final decision on laying criminal charges in B.C., has approved 276 charges against 104 people.

Police say they expect more charges to be laid.


Hopefully, The Courts continue to give first time offenders similar treatment. Trash our City, go to Jail.

What a doofus! So whenever this 20 year old kid is going to apply for a job, he's always going to have to answer 'Yes' to the question 'Have you ever been convicted of a criminal offense?'. I guess he'll be living at home with his mother for the next little while. Not too smart was he? Was it worth it to be an 'ass'?

Nice!!! Finally something good from our justice system.

Just wondering about that rich boy, yes the one set on fire one of the police cars (I think he was part of some canadian olympic team), is his daddy paying for the police car? or as usual the decent taxpayers will ge the bill?

It'll be interesting to see what the rest get, especially that water polo idiot. I wonder if it will be the same judge....and they better step it up from there or they'll make a mockery of.the justice system.

I also wonder if the worst of them will get an indictment over summary. Will the crown be asking for 2 years or more?

Public humiliation would be a better sentence IMHO
that's what the hoosegow provides, a bit of public humiliation. and a month as bubba's fuckbuddy might straighten him out some too

The Mayor should be apologizing to all of Vancouver for how freaking stupid he was. What did the people of Vancouver do? They voted him back in......they're the real idiots!!!! For all of you who live in Vancouver and didn't vote....you should be ashamed of yourselves :nod:

I think hunka said it best.....manni, I sense from your facetiousness that you didn't find much wrong with the behaviour of the rioters that night? Besides terrorizing the city, endangering the lives of law enforcement and citizens, causing millions of dollars in damages and theft from businesses....other than that all OK in your book?

No one is suggesting the gas chamber but I am TOTALLY on line and in favour of jail time for all of them. We need to have a deterrent in place for morons like this who think they can treat our city like a toilet.

the gas chamber bit is for narrative drama, as it's unlikely the hooligans
responsible would actually receive such a sentence. (soft justice system we have in Canada).

not sure why mr know-it-all (aka hunka) got his panties got all tangled up,
