Since the second guy is clearly bigger than the first, this is a total alpha male move. He's letting the shorter guy know that he'll piss where ever he damn well pleases and the shorter guy is just lucky that alpha doesn't actually piss on him. It's a total power play... although it's also such a complete contradiction of urinal ettitquette. Terrible!
Edit to note: I do disagree with one scenario. If #2 and #3 are both taken, I believe that you should go to #5.

For all we know guy on the right is the boss, maybe he "owns" the bathroom
Guy on the right is OCD and always use the same urinal.
Guy on the right just "likes" that urinal more.

If I was at the teller at the bank (not the sperm bank but a money bank) and there were 30 other tellers available and dude rolled up right beside me I would feel the same pseudo discomfort - not real discomfort but would wonder what the dude it thinking that makes him want to do his business right beside me. And if it was a hot chick I would immediately think she likes my ass and wanted some . . .
