Jury awards Apple more than $1 billion, finds Samsung infringed patents

Verdict favors Apple overwhelmingly in a landmark patent decision likely to reverberate throughout the technology industry.

SAN JOSE, Calif. -- It wasn't even close.

After 21 hours of deliberation, a nine-person jury has sided with Apple on a majority of its patent infringement claims against Samsung Electronics. The jury also awarded Apple more than $1 billion in damages.

Apple had originally sought $2.75 billion in damages and although it wasn't unanimous on all counts, the verdict was overwhelmingly in Apple's favor. Samsung, which asked for $421 million in its countersuit, did not receive a nickel. (Refer to jury document at the end of this story.)

The scorecard highlights:

Jury found Samsung infringement of Apple utility, design patents for some (though not all) products.
Jury found willful infringement on 5 of 6 patents.
Jury upheld Apple utility, design patents.
Jury upheld Apple trade dress '983.
Jury found Samsung "diluted" Apple's registered iPhone, iPhone 3 and "Combination iPhone" trade dress on some products, not on others.
Jury found no Apple infringement of Samsung utility patents.
Jury found Samsung violated antitrust law by monopolizing markets related to the UMTS standard.
Damages owed by Samsung: $1.05 billion.

The jury informed the court at 2:35 p.m. that they had reached a verdict which was read in front of District Judge Lucy H. Koh as soon as the parties were assembled. The speed of the verdict apparently came as a surprise: One of Apple's lawyers walked into the courtroom wearing a polo shirt and jeans, so clearly he wasn't expecting this today.

The trial, which stretched more than three weeks, was characterized by a bewildering and massive trove of evidence which unveiled some of each companies' biggest secrets. By any measure, this was a complex case which presented jurors with page after page of technical minutiae. To reach their decision jurors had to work through a 20-page document that required them to discern which devices from the two companies infringed on which patents, a daunting task considering Apple accused nearly two dozen of Samsung's devices.

For Apple it was prototypes of iPhone and iPad designs that never saw the light of day, as well as highly-detailed financial data that went far beyond what he company typically made public. There were also e-mails between executives, one of which included mention of high interest in a smaller version of the iPad.

For Samsung, it was a series of damning internal documents, many of which showed that the company looked to Apple's devices for cues when designing its software icons and general features. One such internal report contained numerous side-by-side slides where the company put a pre-release version of its initial Galaxy smartphone next to the iPhone, and offered suggestions on how to make it more similar.

Historians may want to note that all this took place as Tim Cook celebrated his first anniversary as CEO.

I don't understand the backlash from Samsung/Android fans. Anybody with a pair of functioning eyes could tell that Samsung copied the iPhone to a tee...

According to Samsung it was different, 3 buttons instead of 1 :) It's funny though that both their phone and tablet looked so Apple like yet other competitors like Toshiba and Sony chose do otherwise - unfortunately they failed to gain market share with their products. It took Apple 4 years to develop the original IPhone yet it took something like a few months for Samsung to come out with something similar with the Android OS :rolleyes:

I agree. Don't fight it, just buy Apple's stock. It started the year at $400.00 and may well hit $700.00 in the coming week. And now that Samsung/Google can longer get away with copying Apple features, it is likely continue to perform for years to come.

I don't see what the fuss and buzz is about Apple. Remember this is a company that started by stealing ideas (GUI) from Xerox in the first place. So I say "Fu#K them". Apple products are overrated and overpriced. I agree they make good products but not necessarily the best.

They all steal ideas apple is just as bad as anyone else. but I guess having the civil trial in Apple's own neighborhood with locals who like having apple's economy around didn't hurt their case. The iPhone was original and many companies copied it. But OS5 and the new iOS6 rip off all of androids best features so what does that tell you. not a fan of samsung, but apple sucks ass too. I wonder if apple is going to take this billion and give rebates to all iphone owners, compensating them for the built in charges apple worked itno their profit calculations for lawyers and legal fees hehe.

So Apple wins because the patentable bits, all about "DESIGN", that Samsung has copied are:

- the flushness of the glass
- the rounded corners
- the bouncing icon when you hit the bottom of a document
- the tapping to size an image fully

If General Motors went to court over similar design issues, no other company would be able to produce cars because:

- the front windshield is flush (with the body)
- the center arm rest is a design innovation
- cup holders
- square vents

The Apple case is a pure abuse of the patent process; sure, they were copied by Samsung - but who cares - it's only design!
Patent trials should be about REAL INNOVATION, not the rounded corners of a rectangle or silly bouncing icons. Yes, there will always be idiots who buy cell phones because it might have a waggy dog tail when they search the internet, or they can "swish" from one screen to another, and this is thought of as "cool". But what this worthless battle does is create monopolies, create arbitrary licensing and higher costs, and hurt the consumer.

Real innovation is about new and better technologies that empower the consumer. This crap that Apple has wasted our time and money with is about fashion and nothing more. Apple is behaving more like a Gucci than it is a high-tech products company.

Luckily the violations are easy enough to skirt around because it's only about fashion, and Samsung will hardly be hurt by it. Apple should be showing the public that where it really competes is in the market place instead of the court room. The intelligent consumer, which is the 70% who are not loyal to Apple, see right through their courtroom antics and have contempt for it. Apple is certainly not going to win any fans going about business this way.

If you do your homework you will see TONS of "prior art" ... do you recall the I-Pads in the Kubrick Films Space Odyssey 2001 ?

Actually a big part of the case was about loses in revenue due to the similarities in design and recognition factor That would be the 1.2 billion award .. Now Samsung is going to have to negotiate to use the patent ideas on any products they sell in the US That can amount to some bigger payout and revenue sharing. Or we will see some more suits ..

Tomas Edison did the same thing ... and toke his competition to court for patent and design infringement and he usually won.

Weather i have an apple or not ,, I just got a Samsung Galaxy 2 and love it ... But i would say they are using Apple. idea and innovation even though now apple is behind on innovation

Apple got ripped off by Microsoft and the windows operating system 25 yrs ago because they did not have the money to fight it .. this time they have 90 billion in the bank

No, Samsung did not "win" in Korea. That is a total exaggeration by CBC, and I wonder why they chose to exaggerate. In fact what happened was a balanced result, Apple won some, Samsung won some. It wasn't like in the US, where Apple won unanimously all decisions.

Yes! Totally agree. And all the fanboi zombies walking around believing that all the innovation is done by Apple sickens me. Umm...last I checked, it wasn't apple that invented the smartphone. They take ideas and improve on them before patents are proliferating everywhere. Bullies corporately. They are a successful tech company, but every dog has its day. I am done with them. I fucked Siri, and she wasn't all that.

Mostly off topic other than the South Korean connection - seems like a racist remark unless this meant to be funny - huh huh. BTW, the current leader in the LPGA Canadian Open (being held this weekend in Vancouver) is a 15 year old amateur from New Zealand (yes, I know she was born in South Korea - but she has spent almost all of her life in New Zealand and is a New Zealand citizen). And if she loses, my money is on the current #2 in the LPGA who is American (and caucasion).

Again, Korean genetics but born in the USA I believe. But you are correct - she is very hot! You could recognize her instantly each time the camera found her in this weeks tournament - she was wearing a fairly short skirt and she has fantastic looking legs. She did not make the cut, so you would not have seen her yesterday or today on the Canadian Open tv coverage.

I use an Android and have used a iPhone 4S. Very similar user interface with very little need to RFM (read fucking manual) on either device. Both have their strengths and a few things that I find annoying. The connectivity via iCloud between devices is well done. With my Android I have to upload manually to Drop Box etc for sharing of docs on various devices.

The result of the trial was not a surprise (Trial held in Silicon Valley) but the appeal process will prolong this fight for years IMHO.
