Yes, there is probably some risk in both activities. And it's probably pretty small in both cases. The risk in DATY would be greatest if you had open sores or cuts in your mouth.

And the level of risk likely increases with frequency. Hence why most sp's like to have things covered unless they know the guy very well and trust him.
The risk to her of DATY is very low and most guys are prepared to live with it. The mouth isn't the most hospitable venue for the HIV virus ... you likely have a greater risk contracting herpes or other STD's then HIV through DATY.
If you're concerned you should go see to a clinic or talk to your doctor. There's also a ton of information available on the web about the relative risks of oral sex, although some of it is a bit conflicting.
