The law has no legs.
If an officer asked you to blow two hours after your vehicle was reported driving in a questionable manner, they have to prove it was the person giving the sample that was driving.
They also have to prove you didn't have those drinks after you got home....which isn't illegal BTW.
They then have to prove it was in fact your vehicle that was witnessed, which means they need a person willing to testify.
They also need a warrant if you choose to not open your door.
So what they have to go on in most cases is a witness that would prefer to remain anonymous , a citizen that simply refuses to open his front door to police....a vehicle that's engine has already cooled down over two hours of not being run....and a questionable law to enforce, that has some pretty weak legs to stand on.
It'll be struck down within a few months....

" I just let some random dude test drive my truck as he heard I'm putting it up for sale....he must have been swerving to check how tight the steering was....I've been in my house since this morning officer"

Just as though they were vampires, refuse to let them in & tell them "I'm refusing your request for a voluntary breath sample. Please come back with a warrant. I'm calling my lawyer." Don't say anything else, (just pretend you're Marshawn Lynch) & just keep repeating that one paragraph!

Driving erratically so you get Breathalized in your own living room & charged with drunk driving? NO that won't make for a slew of scurrilous accusations by spurned partners, will it? "Hello police I'd like to report that I just saw my soon to be ex boyfriend driving his truck in a dangerous way; I know he's home now (with his new girlfriend maybe) & I am sure he'd been drinking before he came to my place!" No chance of exploitation of the law there at all.....

Shit I have a 97 dodge diesel that wanders all over the dry pavement while I'm stone cold sober.
I've been pulled over twice by the cops thinking I was drinking.
When I drive any of my other diesels I find I'm over correcting myself by habit, it's so bad.
It is also my opinion that there are more good cops out there than the bad, and most won't be enforcing this Draconian new law .... But I suppose there is a little Vampire in us all.
Yup my 1999 Ram 2500 gets a little wandery from time to time too, especially when I'm driving in the dark in unfamiliar areas!

I cannot see a prosecution based on a breath sample taken after someone gets home being successful.

In fact, police officers themselves have been aquitted claiming they drank after getting home. Monty Robinson was famously convicted of obstruction after killing someone but not for impaired driving. He claimed he went home and had vodka.

In most jurisdictions police are far too busy to go hunting people down after vague complaints about bad driving.
I got hit by a drunk, chased the guy, Called 911 and told them, despatcher said they were "too busy, just get his plate and call MPI."

That shows how much priority this has.

Here in Winnipeg everyone drives erratically. It's called dodging potholes the size of moon craters. :)
Yes. People also drive much differently here on Vancouver Island than they do on the mainland. Much SLOWER for one thing. It's been a really long time since I lived anywhere that the transit service was so shitty that everyone who CAN drive, does. It took me almost 2 hours to get home from Lady Vanessa's place to my home on the bus: I can drive it in under 15. SO MUCH BLUE HAIR & HANDS behind the wheel!!!

Yeah ,whenever I've been there they park and drive using the Brail method, because they can't see over ...or past the steering wheel.
