Nova Scotia sex worker takes client to small claims court over unpaid fee

This is a very interesting legal case. The client made a good point. He argued that since paying for sex is illegal , the contract of services is also illegal.
So the court has 2 options:
- Agree with the defendant and dismiss the sex worker claim. But that would create a loophole in the law. Every sex buyer could just get service and then refuse to pay since the payment is illegal
- Validate the claim of the sex worker. That would challenge the prostitution laws implemented in 2014 because the court would declare the payment as legal, this would refer the case to higher courts.

Thanks for the share. 😊. And interestingly if he court agrees with the plaintiff this would also open the argument for pooners to sue sw over non performed acts. Although i fail to understand why she's wasting money on this case as even if she wins its going to take a long time and potentially the same amount of money...

The client gave the SP a real bank card with his real name, and it was enough for her to leave without getting any cash? Doesn't make sense to me.

She wants to make a case that Sex workers are entitled to get paid for their services which would challenge the existing law that considers such transaction illegal.

Typical government hypocrisy! CRA will go after this gal to ensure that she pays her fair share of income tax and will use the full force of the law to collect, even if it is the proceeds of illegal activity. However, if she wants to use the full force of the law to get paid for services rendered, oh no, no! That's different.
