Is it illegal for a SP to video record ??????

I have tried to put this up here a couple of times without pointing any fingers while things are under way. So lets get your opinion.

So what do think if an SP is video recording your visits and not revealing it ??? Say until several months later, and then when she does she wants a fair sum of $$$$ to not spread them around.

Would you be a little suprised ???
Would you pay up ????
Would you run like hell ???
Would you go to the authorities ????
Get a Lawyer ????
Maybe Beg not to expose the tapes ?????
Or call her bluff and post them yourself ????

Sucks but true, and it just recently happened to me. And Yes, right hear in little old sleepy Victoria. Unfortunately I cannot name the SP yet, as for the next few months a lot is going on. I have been told I cannot say exactly the SP's name, but it is ok to give you a general area to avoid which should eliminate you getting caught by her also. And it might be you are next on the list and have already been recorded, lets hope not.

So let the discussion begin if you want. One thing I can tell you is who it is not. Want more info then do a PM.

Blackmail is illegal and should be reported to the police. Even anonymously if need be so they can at least get this on their radar. I guarantee you are not the only one. For me it would likely be a little embarrassing professionally, but I have no SO. I am sure many gents on here got an instant pit in their stomach reading about this.

This is bad for business for the ladies as well. I am sure bookings will die down in general until this blows over or is cleared up. If I was an SP I would run whoever this is out of town.



I wish you the best navigating this ugly situation.

If this was recorded before C-36 came into effect, then I don't believe what you were doing was illegal, whereas she is blackmailing you and that is illegal.
I'd say you would have grounds to take the case to the police.

And are you sure she really did record the visit? Have you seen evidence?
I would demand proof that she actually did so.

If this was recorded before C-36 came into effect, then I don't believe what you were doing was illegal, whereas she is blackmailing you and that is illegal.
What he said, plus recording without consent was already illegal, BC Privacy Act.

You can prosecute even if she does not spread the tapes. I'd think do not talk to her, either police or lawyers are better, depending if you think the tapes are incriminating.

Did you speak to a lawyer? I would definitely do that first.

She does violate the Privacy Act and extortion is a criminal offence in Canada.

Of course we don't know your family situation, these are things you will have to weight.

Hope things will work out for you.

Video or emails and text are all possible extortion items. I had a gal threaten to show emails to my wife because I told her where to go. But she was going to have a male friend do the deed. A Surrey gal from Vietnam. Short and talkative. If you are involved with her be careful. She collects things. Still around but I ditched her six months ago. She never did anything but it was cause for pause.

Don't let yourself be victimized, report her to authorities she'll be arrested immediately assuming you have evidence. Seems strange you can't mention her name if she poses such a threat...

I get the impression that he has contacted a lawyer and possibly LE regarding this.

Quazi-Legal opinion

Its probably not against the privacy act in this situation as it could be argued that the film's production was "personal" in nature... or at least there is a strong argument to be made against it anyhow. From a privacy act perspective (at least in BC), only one person in the room needs to know that they are being recorded unless its a commercial situation (trust me, you don't want to go down that path, as you were paying for "time & companionship only" right?).

It IS however against the updated section 162 of the criminal code which came into effect in December:

162.1 (1) Everyone who knowingly publishes, distributes, transmits, sells, makes available or advertises an intimate image of a person knowing that the person depicted in the image did not give their consent to that conduct, or being reckless as to whether or not that person gave their consent to that conduct, is guilty
(a) of an indictable offence and liable to imprisonment for a term of not more than five years; or
(b) of an offence punishable on summary conviction.
(2) In this section, “intimate image” means a visual recording of a person made by any means including a photographic, film or video recording,
(a) in which the person is nude, is exposing his or her genital organs or anal region or her breasts or is engaged in explicit sexual activity;
(b) in respect of which, at the time of the recording, there were circumstances that gave rise to a reasonable expectation of privacy; and
(c) in respect of which the person depicted retains a reasonable expectation of privacy at the time the offence is committed.
It is also against section 346 of the criminal code and carries up to a life imprisonment sentence.

346. (1) Every one commits extortion who, without reasonable justification or excuse and with intent to obtain anything, by threats, accusations, menaces or violence induces or attempts to induce any person, whether or not he is the person threatened, accused or menaced or to whom violence is shown, to do anything or cause anything to be done.
While its a clear violation of 346 typically its a more difficult accusation to prove .

While you couldn't necessarily catch her on section 162 for "making" the video if it was made before December 9th last year when this section was amended, if she threatened to release it after the date, shows it to anyone else, uploads it, emails it etc, then she can face a criminal code conviction and up to 5 years in prison. There is a big appetite to clamp down on this sort of cyber bullying in light of the Rehtaeh Parsons case, and the search and seizure powers attributed to this section are extensive. (In other words, you're safe to go to the cops, they will treat you as the victim here and they can get a warrant with relative ease to seize any electronic devices that she owns, not to mention petition email providers, Facebook etc for access to her accounts.)

You are the victim here. There is nothing to be ashamed of. In this situation you will be treated with respect. To put your mind at ease, you have not breached the law if the act took place before the 6th of November last year. Even if it happened yesterday, you should still to go the cops as on balance, its in the public interest to prosecute her and let you walk.
