There's no real contract here. Having said that, if it is true that he does owe her money, she should provide evidence that during their relationship she was supporting him and then she would rightfully own the ring. If not, then the marriage contract was broken and the ring should be returned. By the looks of this case its gonna be a messy one.

I also noticed that these days a gift (as in what you would give at Christmas time) is now also expected at Valentine's day, particularly if the female is under 30. That's also due to marketing. I did a search and the courts in Canada tend to see that there is an implied contract when an engagement ring is given, and that the contract is that they marry. Apparently most courts rule in the man's favour when the woman breaks it off. This is to stop opportunists like you, I suppose.Where is the said contract? Presumably a woman who gives back an engagement ring, remember under the context of engagement, doesn't love him anymore, or the love has no realistic expectation of lasting. So the ring then becomes a memento of a lost love, and a sort of trophy of some significant sum, if you will. That makes me wonder what kind of woman would keep such a thing, because in my mind, a worthwhile woman wouldn't see the point of having such mementos and certainly wouldn't be eyeing it for it's dollar value. In this case, I suspect the latter.I do believe it is a gift of love and does not need to be given back regardless who ended the relationship.

Yes I did, but I thought I would put up the poll to see what people here would say.If you have done any reading on the subject as I have you will find that under many circumstances "The Courts" not BBB have found in favour of having the engagement ring returned.
This seems to be one of those circumstances where she may end up keeping the ring because of his unsubstantiated debts to her.
It does beg the question though: Why would a woman want to keep any ring given as an act of love that has since died?
