The owner of a Burnaby brothel says he was “very scared” when a customer emerged from a bedroom with his arm around a prostitute’s neck and a gun to her temple.
Testifying at a murder trial in B.C. Supreme Court in Vancouver on Wednesday, Xing Li said the customer loudly informed him and Ping Li, the woman he was holding, that it was a robbery.
“I was taken aback. I was very scared. He then asked me to go to one side. Right away I walked over there. He said, ‘You lay down, lay down.’”
An accused who was 17 at the time of the offence and who cannot be identified due to a publication ban has pleaded not guilty to the first-degree murder of Ping Li and the attempted murder of Xing Li, who now lives in China.
Li, 54, no relation of the murder victim, told a jury that after being ordered to get to the ground, he kneeled down in the 25th floor suite of the Burnaby highrise.
He said he then put his hands in front of himself and the customer kicked him in the buttocks once.
“He asked me for the [building] access code. He said he had a partner waiting downstairs and to let him come up.”
Asked by prosecutor Brendan McCabe what he did at that point, Li said he stood up and said he had $100.
“What happened next?” said McCabe.
“Then he was pointing the gun at me and he said, ‘Do you think the gun is a fake? He said, ‘Asian pigs,’ then fired a shot.”
Li said the bullet struck him in the left side of the shoulder.
“I fell on the ground and felt my whole body was numb.”
A short while later, Li said he heard Ping Li talking to the gunman, saying ‘Let me live. I will give all my money to you.’”
Then he heard two more shots fired and within a “very short time” the sounds of the man fleeing the apartment.
Li said he waited to make sure the man was gone before he shouted out to his wife, who was in the master bedroom.
“Did she come out?” asked McCabe.
“Yes, she came out and she saw me lying on the ground and said, ‘What happened? What happened?’ I just told her, ‘Don’t ask too much. Call 911 right away.’”
The Crown witness said his wife called 911 but because she doesn’t speak English, she handed him the cellphone.
“What could you hear Ping Li saying, if anything?” asked McCabe.
“Ping Li was saying in Mandarin, ‘Help me, help me,’” replied Li.
He said his wife went into the guest bedroom but soon after came out and said, ‘She’s not well . . . she’s not going to make it.’”
Asked by the prosecutor if anyone in the courtroom resembled his assailant, Li stood up in the witness box and pointed at the youth siting in the prisoner’s dock.
“That person,” he said.
Li, who testified with the help of a Cantonese interpreter, described the firearm as a rusty-coloured pistol about 10 inches long.
Court has heard that after the March 2009 shooting Ping Li was rushed to Vancouver General Hospital but died shortly after arrival.
Xing Li was rushed to Royal Columbian Hospital, underwent surgery and was put under a drug-induced coma.
The trial continues Thursday.
