If it's his real number, and you want to go after him for this, you might want to see if you can get him to talk about what he did in text messaging, to create some more evidence. That's not legal advice though, gotta talk to a lawyer if you want that.

CBC News covered a recent decision by the Supreme Court of Canada in regards to “stealthing.” “Stealthing” refers to the non-consensual removal of, or non-consensual failure to use, a condom during sex. The Supreme Court has decided that stealthing constitutes sexual assault.

I would add that the Supreme Court was also unanimous on this point. There was a 5-4 split over the specific legal reasoning regarding why it constitutes sexual assault, but they were 9-0 that it's sexual assault.
