Tampa, Fla. — A teacher will claim she was insane due to emotional stress and did not know right from wrong when she had sex numerous times with a 14-year-old student, her lawyer said Monday.

“What teacher in her right mind would do something like this?” lawyer John Fitzgibbons said after a brief hearing for his client, Debra Lafave, a middle-school reading teacher.

The judge agreed to appoint two mental health professionals to evaluate Ms. Lafave, 24. Prosecutors have said a state psychologist already determined Ms. Lafave was not insane, while one hired by the defence concluded that she was mentally ill.

Ms. Lafave's trial was set for Dec. 5 on four felony counts of lewd and lascivious battery and one count of lewd and lascivious exhibition. Each carries a maximum 15-year prison term.

Mr. Fitzgibbons said plea bargaining broke down because prosecutors wanted Ms. Lafave to serve too much prison time, though he did not give details.

“To place an attractive young woman in that kind of hell hole is like putting a piece of raw meat in with the lions,” said Mr. Fitzgibbons. “I'm not sure she would survive.”

A state attorney's office spokeswoman didn't immediately return a call seeking comment.

The boy told investigators he and the teacher had sex in a classroom, her house and once in a vehicle while his 15-year-old cousin drove. He said Ms. Lafave told him her marriage was in trouble and that she was aroused by the fact that having sex with him was not allowed.

US Kangaroo court and it's ridiculously long potential sentences in action again... 15 years max on each count maximum... what a joke. There was a similar case here with a Sechelt teacher. I think she got minimal to no jail time.

Its all about the double standard....

If it was my son...I will give him a pat on the back.....if it is my daughter...I will give the teacher 5 mins to run away from my sniper rifle.

OK seriously, I know in this politically correct age, we're supposed to say that it's the same whether it's a girl or a boy. But, we all know it is not.

Not least, there is no risk of a male teenager being impregnated. So, the risks are fewer (not non-existant, but fewer)

But still, it's NOT the same and every one of us who's been a 14 year old boy knows it.

That's not to say it's right. She should be punished, certainly she should never teach again, but I don't believe her punishment should be as stiff <ahem> as if the genders were reversed.

It is not about being "politically correct" - an argument, by the way, I think is rolled out too easily I think to justify some things - for an adult to sexually exploit a student ten years their junior, and under their power.

You trying to tell me 14 year old girls (some of whom physically could be mistaken for 18 year olds) don't get sexually attracted to good-looking men in their 20's? So why isn't it okay for a male teacher to fuck around with a female student, then? Girls mature faster than boys, right? They should be able to handle it, right? It's a slippery slope....

I was a substitute teacher in a different life, and having spent ample time around 14 year olds, it is unbelievably naive and obtuse to think that males at that age are "okay" to be having sex with adults. Sure, it's possible some boys (maybe most) would get off on living a fantasy, but don't think for a second that there isn't a huge risk of fucking that kid up for life.

It's not just about sex - it's about people in power, trust, and the relationship children have with the adults in their life who are entrusted with their care. It's about how these children will view relationships in general, and their attitudes towards people societally above them in the power structures of life.

True, many teens are starting to become sexually active before that age, and are far from being inexerienced. But just as many, or more in my experiences, are nowhere near that stage - and do not have the emotional or brain maturity to carry out a sexual relationship with someone who, in many cases, is old enough to be their parent.

We're talking about an age where kids have enough trouble managing their emotions, making good decisions, and struggling with their own identity, much less manouvering their way through something as complicated as sexual relationships.
