Maybe the Chiro was not very good

I can admit that it is a little tricky, but chiropractic care is not all that bad. I didn't realize how messed up I was until i went to a chiropractor and he substantiated it through x rays and other tests. After a few months of treatment, there was a day and night difference in my neck mobility and pain in my upper torso. The lady probably had a bad chiropractor.

It is a class-action lawsuit, which means that if she succeeds, everyone who suffered an injury due to manipulations by a chiropractor can receive compensation. So depending on how many people have suffered injuries since 1998, the $0.5 billion can be reasonable.

So now we have someone suing the government for not strictly regulating the alternative health industry...

Meanwhile when the government does try to regulate alternative medicine (you know, things like saying that the place where the pills are made can't be infested with rats, stuff like that), there are massive protests.

Should she get every penny of the chiro's personal assets? Probably.

Should she get one penny of taxpayer money? NO.

They are going to have to prove alot of negligence in this case, reminds me of the other case, where the judge tried to sue the laundrymat for $50 some million because they lost his pants!:rolleyes:

I don't think anyone is for residential schools. In fact, I seriously doubt anyone on this board would ever have voted for, or supported, such a horrendoues thing...in fact... nobody on here probably had anything to do with it, although there is a possibility that someone on here might've gone through or known someone that went through.

I think that as a matter of law only people who have been injured in the last two years can actually sue. When I did see a chiro ONCE he advised me of all the risks and made me sign a release, of course that wouldnt have held him harmless in the case of negligence.

She'll probably end up with a few mill out of court hush money.

No. But I also don't like paying for something I didn't do. It's fine for the government to give them something for there suffering. But how many people are going to cash in on something that didn't really effect them? Yes some do deserve it. Same with this case. I dont care what colour your skin is. Enough with the gimme gimme gimme attitudes.

well, as someone posted, she filed a class action lawsuit, that is she has filed the lawsuit on behalf of other Albertans who were injured from these manipulations since 1998. So she is not suing for $500 million for herself. In fact, if she wins (and a big "if" here), the amount she will be get will be much lower than this figure.

Firstly, before there is any talk of liability, negligence, damages and cash award, the court will have to decide whether to certify her action as a class action or not. The Court decides if the action warrants class proceedings. The court will look at many factors, and the defence will put in their submissions, probably that this is just an individual claim and doesn't warrant class action certification. The first thing is whether a class proceeding is the appropriate action to take, or should claims be made by each individual suing by themselves?

Secondly, if the Court does certify it as a class action, then they will have determine if indeed these manipulations caused her injury, and if so, can and did they cause others.

If this case does get certified (i doubt it), then the Court will have to determine what are the damages (it is not $500 million or nothing, it can be anywhere in between), and how many patients are entitled. After the plaintiff's lawyers get their fee (millions here), the class will divide up the remaining amount. Of course, at any time before a Court rules (if it even gets to trial), the sides can agree to a settlement.

If this case doesn't get thrown out as I have my doubts as to whether it should be a class action or not, then this will be a very long long legal battle and a costly one, as I don't see the Alberta Govt or the Chiropractors agreeing to settle.

The suit involves ONE chiropractor, not all of them. There would have to be separate suits against each of the others for their patients to claim injury.

I think the damages awarded, if she can prove her condition is the result of the chiropractic manipulation, will be no more than $500,000. This would be in step with Canadian precedent; don't be misled by American examples.
