OSLO (Reuters) - A Norwegian court has sentenced a woman to nine months in jail for raping a man, the first such conviction in the Scandinavian country that prides itself for its egalitarianism.

The 31-year-old man fell asleep on a sofa at a party in January last year and told the court in the western city of Bergen he woke to find the 23-year-old woman was having oral sex with him.

Under Norwegian law, all sexual acts with someone who is "unconscious or for other reasons unable to oppose the act" are considered rape.

The court sentenced the woman Wednesday to nine months in jail and ordered her to pay 40,000 Norwegian crowns ($6,355) in compensation.

"This is a very harsh sentence," the woman's lawyer, Per Magne Kristiansen, told the Norwegian news agency NTB. The woman argued the man had been awake and consented.

The prosecutor had sought a 10-month sentence and argued the court should not be more lenient with a woman than a man. It was Norway's first conviction of a woman for rape.

Norway has long traditions of equality -- 40 percent of the cabinet of Prime Minister Kjell Magne Bondevik, for instance, are women.

I understand why the prison sentance for raping someone, but financial compensation? Does he normally charge for the service and asked for compensation since she got it for free? Wheeew... at $6,355 per encounter that makes the dude one hell of an expensive male SP.

And was she really that bad at a BJ that he brought charges against her?

I think that's brilliant.....

While I also don't understand the financial compenstaion bit, I think that the sentence was fair and justified, albeit a little ground breaking.

Now, I am a feminist, but to me that means equality accross the board. Not special rights for woman. In developed countries, we have come leaps and bounds in leveling the playing field with regards to woman being compensated equally for equal work, we now recoginze that men and woman react differently to medical treatments, so we now ensure that research studies make a distinction etc. etc. etc. There are areas that still need improvement, but for the most part, I think we have caught up.

It is the men who now seem to be at a disadvantage. Sure, society has a double standard with regards to sexuality. But not everybody fits into that mould. It can be every bit as traumatizing for a man to be raped or assulted as it is for a woman. I would imagine that men would just be less likely to come forward about it. I applaud thier court system for being truely non sexist on this decision. I hope it is an indication of true equality in the future - both in their country, and in ours.

I sort of agree with this, but it is this attitude which leads to why men and women will never be treated the same. If you ever find yourself in divorce court or something similar I think you may sing a different tune.

Children almost always go with the mother - not the better parent. That needs to be changed.

When the man does get custody, why is it that the woman dosn't then need to pay child and/or spousal support?

But getting back to the rape situation, I do think that was a huge step in the right direction. The man obviously felt violated, or he wouldn't have made the effort to come forward. Just because you would find it flattering or a good thing, doesn't mean that is how every man should or would feel. Maybe it was religious, maybe he was in a relationship and didn't want to be cheating - even if he had no control over the situation. Maybe he is worried about STD's. Maybe his personal creed or morals just don't allow him to think of this as a good thing. Heck, maybe he's gay (and having a woman go down on him would be like having a man give you a BJ. I'm guessing you wouldn't be too happy about that one)

The fact of the matter is that it doesn't matter how any man here would feel in the situation. It is how he felt. And the fact is that he was unconscious, and was put into a sexual situation where he had no say in what was going on. If it was a man who did that to a woman, nobody would doubt it was sexual assult. Why should it be different because the tables are turned.

With regard to child support, the law is that the non-custodial (as in who provides the day-to-day care) parent pays child support based on their income. So if you are referring to a particular case, here are some possible explanations:
a) mom doesn't work, therefore has no income on which to base the child support payable;
b) custody is "shared" or both mom and dad have the kids close enough to 50% of the time that child support is not payable in the circumstances;
c) dad waived his right to support;
d) mom has health and dental coverage for the kids through her employment; or
e) dad earns more than $150,000 per year.

There are myriad other reasons, but pt. a) is key - all the rest are exceptions to the genereal rule....

Spousal support: too many factors to go into here. If you are that interested, pm me...
