Lawyer in India gang-rape case says victims to blame

"He said the two victims should not have been travelling on public transit late in the evening, and the man who was beaten had failed to shield his female companion from harm."

    not quite

in canada it wasn't until 1918 that all female citizens aged 21 and over became eligible to vote in federal elections. in 1919 they gained the right to stand for the House of Commons, although the right to be appointed to the Senate didn't come until 1929

i was alive when cases of statutory rape (underage sex) still reveiwed in court the girl's detailed sexual history. if you could get a handful of your friends to testify that they had engaged in sex with the girl, you walked on the statutory rape charge

Why are people harping on the defense lawyer? It's his job to create doubt, however ridiculous it may sound.

How about because lawyers like this are scumbags who deserve 1 pound of lead weight chained to them for every plain as day guilty scumbag that have had aquitted and then thrown over the side of a boat into deep water so as to let those many pounds of lead drag them to the bottom where they deserve to be.

I suppose for the same reason people harp on people who willingly do these jobs:

    1. Soldiers in 1989 in China who used assualt rifles on unarmed civilians in Tiananmen Square.

    2. Nazi atrocities to Jews in concentration camps in WWII.

    3. Abortionists who rip babies to pieces.

The defense lawyer was doing his job. The argument was unfortunate (I don't think a North American lawyer would have used it), but the defense lawyer is an accused's only means to level the playing field against the vast might of the powers-that-be and public opinion. The lawyer is the only person standing beside you when all are against you. He is bound by the rules of his profession to act in your best interests regardless of his personal beliefs, and no matter who you are.

Stormrider says: "How about because lawyers like this are scumbags who deserve 1 pound of lead weight chained to them for every plain as day guilty scumbag that have had aquitted and then thrown over the side of a boat into deep water so as to let those many pounds of lead drag them to the bottom where they deserve to be."

Who says these "scumbags" are "plain as day guilty"? You? You whose knowledge only comes from the media reports of these matters? What if we left all justice to public opinion?

Oh, and if and when you are charged with a criminal offence, or if your wife wants to divorce you and take you to the cleaners, you better not call a "scumbag" lawyer to help you, okay? Do it yourself and see how it turns out.

    Oh, same for you, Lenny.

No matter how offensive we all find it, even the creepiest people on this earth do get legal representation in court.

    Clifford Olsen?

    Willie Picton?

All the serial murderers from history all got lawyers. Suffice it to say it repulses me but since we are all seen as equal under the law, we all deserve legal representation. How many times have we heard the defence lawyer state "she was dressed in such a way that she deserved it". It's a mind set we have to change.

Wow! You (along with wilde & Sharky66) are way off topic. This isn't about lawyers in general. Neither is it about anything else you said.

The point was that doing a job does not excuse someone from being justifiably "harped on", to quote poster wilde.

If you commt immoral acts or make stupid "ridiculous" evil comments in doing your job, you deserve to be "harped on" and should be.

The Nazis used the same argument as wilde, that they were just doing their job when commiting atrocities. The courts didn't buy it.

So wilde's argument that he shouldn't be "harped on" because it's his job to make such ridiculous comments is, therefore, ridiculous.

If you can't tell the difference between a Nazi and a lawyer, you should get your head examined.

A Lawyer saying "It's her Fault just because she was there" is vastly different from a Lawyer saying "According to my client, it's her fault because she said she wanted to try a gang bang, but then she changed her mind after".

In the first case, it's obvious bullshit. How can anyone in their right mind believe that a person just sitting somewhere minding their own business is inviting violence. Anyone who makes that claim that isn't worthy of the ground they walk on. If the client made that statement, the Lawyer should council his client against that approach and attempt a more viable argument. Aside from being an ass, he's actually doing his client a dis-service.

In the second case, the Lawyer might believe the client is lying, but the lie is still possible - if the client wishes to base his case upon that lie, then the lawyer's job is to do the best in representing the case using that lie.

Actually, I remember him mentioning this once a while back. Apparently, if I remember correctly, it was for religious reasons. Yeah, another shocker. lol

Not sure how that works considering the rest of the things he posts about doing.. but hey, most religious people seem to be selective about what parts of their religion they follow. And then just pretend the inconvenient ones they choose to ignore just don't exist or aren't really that important. lol

But yah, this one's rather surprising.
