Is chatting about sex for money online illegal?

I'm wondering if it is illegal to chat with an SP about sex and prices using instant messaging (MSN, Yahoo etc). Section 213 (communicating law) of the criminal code seems to be pretty clear that its only illegal if it is in a public place. I would think that instant messaging from your home would be considered a private location. Anyone had any any experience with this?

instant messaging in private messages would be just like a phone conversation.

Talking in an open 'public' chat would be more questionable.

But, if you look at the solicitation laws, they're pretty specific.

Hmmm not quite sure what that rant was about. I'm thinking that with english not being your first language you may have missed the point of my post. I really didn't feel that I was making a big deal about instant messaging. Just simply inquiring as to whether or not anyone else had any experince with the legal side of it.

I am certainly no lawyer, however as an IT guy I am aware that communication over the internet is not always considered private. For example if you were silly enough to be doing it through your work network or email account then you would at risk (for your job, plus since you don't have an expectation of privacy also for the communications law I would think). I have also seen a few ISP that have policies that would potentially open you up to concerns.

Thanks for the reply. I was speaking strictly about private MSN messenger or similar messaging programs. No public chat rooms, no work emails, just two people in their respective private homes, discussing sex for money in a private one on one chat. I am curious as to the ISP policies you were talking about. Do some have wording that prohibits that sort of communication? Or is it some other concern?

It is considered a private conversation and is 100% legal. Girls can quote prices, etc. Guys can ask anything they want.

Chat rooms are a hazy area, but police have much better things to do with internet time than to bother sps and clients.

Something to be VERY careful about.

If the person you are chatting with is underage, then you're breaking the law and it is up to YOU to be sure they aren't underage, even if they lie and say they aren't underage, if it turns out that they are and you get caught, you're up a creek.

Otherwise, as I said earlier, private instant message chat is considered to be like a phone call legally.

JJ, I was commenting on a post that got deleted. Thanks for all the replies. As for confirming their age, I'm assuming you mean if you actually met them in person? (common sense) I can't see how you could be held liable if you all you did was chat with someone who said they were of age but weren't. I don't see anyway that you could confirm someones age online.
