Calgary store wins trademark battle with Barbie

Barbie will have to share her name after parent-company Mattel lost a copyright battle Monday to Barbie's Shop, an adult clothing store in Calgary that offers customized items for "bad boyz and girls."

The New York judge ruled that Mattel had no jurisdiction in Canada and that owner, Barbie Anderson Whalley, can keep the name of her store and website.

"It was awesome. You don't usually hear about the little guy winning up against giant corporations… they have a lot of money to play the game," Whalley told CFCN News in Calgary.

Mattel sued Whalley in July of last year claiming that her internet site, BarbiesShop.com was too close to Mattel's official Barbie site, Barbieshop.com.

Whalley refused and countersued stating that she was using her legal name, Barbie.

In December 2004, Whalley was going to give up her fight.

"I can't afford to play the game," she told The Calgary Herald just days after receiving a bill for $8,300 US in lawyer's fees. "I feel like I've lost, big time."

Now, Anderson says that she couldn't be happier.

Mattel started selling their famous Barbie in 1959 after designer Ruth Handler was inspired by her daughter's fascination with cutout paper dolls.

She named the doll Barbie after her own daughter Barbara's nickname.

Mattel has 30 days to appeal.
