I get an email or two a day offering photographer services, Viagra, penis lengthening, somebody needs my help in Naigeria, etc, etc. Some photographers say free, they are just trying to build their portfolio, others want me to pay them ridiculous amounts of money, when all they show me are amateur pictures on a website that has other amateur photographers on it.

If you don't have your own portfolio with decent photographs, then you have nothing to offer in trade, lol. Personally there are a lot of great photographers out there. I would rather pay the money to someone known, but good luck finding what you are looking for :)

Willing to do trade for ?
A kind soul pointed out to me that I should be a little more specific about what I'm offering and what I'm looking for in return.

I have been involved with photography since the early '70s with a background in film. I moved into digital a few years ago and have been shooting with a full frame DSLR for the last two or so years. I have an extensive lens collection and a portrait and a personal portfolio available for review on request.

In return for taking your photo, I ask that you sign a release stating that the photos are my property and that I can use them for my personal advertising and promotion. Of course, you also get the right to use the photographs for your advertising and promotion. I am not looking for services and have no problem with you having an escort as long as they do not interfere in the shoot. Meeting somewhere public prior to the shoot so you can get to know me is not a problem.

The shoot would be entirely up to you with regard to content. I am not asking to shoot nudes, fully clothed is fine with me. I am looking to expand my portfolio so I would prefer to do something a little less "fashion shoot" if possible.

Sorry for any misunderstanding.

Here are a couple of my photos, PM me for more information.

Signing rights away to photos is something you should be very wary of in this business and in this case, you have no idea where the photos might end up. Furthermore, bartering & placing an unpaid ad are not the marks of a professional. Sorry Rocky but your whole pitch reads shady to me.

Sorry you feel that way. I'm looking to build a portfolio and am offering a free service in exchange for use of the photos in my own promotion. I've done some work with models from a website called Model Mayhem but thought I'd see if anyone here was interested. If nobody here is, that's cool.

What's wrong with TF* (time for images) work? I don't agree with a full release like that, but the TF* doesn't strike me as odd.
The release I use is pretty standard stuff, it's not like I made it up out of the blue. I'm not looking to become a porn vendor, just a photographer with a varied portrait portfolio.

Actually, she signed a release I downloaded from a stock site. It's a really broad release but I did hesitate to post it on this board and didn't until I was asked to prove I could take a photo. Seems you just can't win on this board...

How many releases do you have of the people in the photos on your Facebook account?

Under most copyright laws, Canada included, the photographer owns the pictures and has the rights to use them to promote his business. Having a signed agreement isn't signing any rights away but just acknowledges that she understands what the pictures can or can't be used for. Many model/photographer agreements actually limit what the photographer has the legal right to do with the photos.

Before some of this gets too out of hand, let's correct some of this well intended misinformation right now.

We went through this at length previously and I had to get the lawyers to sort it all out properly, as to how it pertains to the adult entertainment business (which is different).

Ownership of photos / copyright is NOT the same as being able to use them publicly in whatever way you want. The default right to show them publicly (ONLY in cases where there is nudity / sexuality, etc, involved) is non-existent unless a model release specifically allows you to do that.

Typical TFP / TFD (trade for prints /disc) with no payment involved, is that both sides can use them in their own portfolios.

There is one unusual case locally (and possibly others) where they're extending it to use it commercially. That's very tough legally as you have to prove to the judge that the mutual value rec'd was fair and balanced.

While I'm at it, there's also some question about the legal age to model for adult work in BC. In practice it's 19. You can legally sign a contract in BC at 18, BUT the judges have consistently ruled that if you were 18 at the time of the contract, and indicate that you didn't properly understand the impact that it could have on you (because you were too young and inexperienced), then it can be overturned. I.E. A contract in the ADULT industry at 18 in BC isn't worth the paper that it's printed on.

Just to keep things straight (from the lawyers that specialize in the industry!).

Photo Use

JustCallMeR is correct.......

yes the photographer holds the copyright to the images they create but that does not alow them to use the images as they wish without a signed model release. A release from the model can limit the use of the images as well as a release from the photographer can limit or specify the uses for an image.

There are generic Trade for CD release forms that specify use only for self promotion for both parties and no other commercial use unless further written permission is given.

Interesting images can be created that do not show the models face/identity that both could use for promotion.
 
I know from doing hobby modelling that it's standard, and that you have no ill intent, but as an SP you have to weigh your own discretion against free photos sometimes.
I agree. If you are concerned about your face being shown to the world its best to hire a photographer and just pay upfront. If not, TFP is a win-win situation.

When I read Rocky's initial post I was very skeptical about his intentions and whether or not he was a "real" photographer. I pmed him out of curiosity and to my surprise he sent me links to a couple of very impressive portfolios. We met for coffee, discussed the type of outdoor shots I wanted and did a shoot a few days ago. I can vouch that he is polite, easygoing professional, experienced, and drives a nice car;)

Great pictures you've done on Miss Jasmine, although I'm willing to bet its easy to make her look stunning cause she already started out that way.

I am amazed at how jaded this industry is, NO INSULT intended!! I was debating myself about offering some free website work to get into this industry, coming from mainstream business web site development / SEO.

I think as mentioned above, with some protection in place accepting the offer of FREE or reduced shouldn't be a flag in itself.

I for one want to keep the two separate / my mainstream business separated from ahhhhhhh little controversial business. I'm sure some of my more "stuck up" clients would disprove.

You're absolutely right about Miss Jasmine, she is stunning!

With regard to blurring your face, if the photos taken are more of a "fashion" style, is that still an issue? I can see (and have no problem) where discretion could be an issue and would respect those wishes.
